Is it legal to waterboard our soldiers if they are captured? Why hasn't any Senator asked that
question? It's pretty obvious that if the answer is no, then it's not legal for us either.

1. I think the Geneva Conventions are supposed to cover our soldiers

if they're held by another nation's army--if it's stateless terrorists, I imagine they would just do whatever they wanted. That's the rationale behind our new torture policy for "enemy combatants"--they're not soldiers, so they don't fall under the Geneva Conventions. At least, this is my understanding.

12. It has been asked
several times in Committee, and Leahy said just the other day that if an American soldier were captured and waterboarded we'd be screaming bloody murder. I can't for the life of me figure out why you or the OP think it hasn't been asked.
