While we're waiting for the judge's decision on our request for a Temporary Restraining Order, news of our motion is gaining attention. The Associated Press ran a piece that has been picked up across the country:

An ethics advocacy group asked a federal judge Thursday to order the White House to preserve tapes used to back up its e-mail system.

Asserting that the White House may not have kept copies of e-mails that are at the heart of a dispute over the Bush administration's record-keeping, Citizens for Responsibility and Ethics in Washington filed a motion asking for a court order to preserve computer backup tapes.

"The White House is refusing to confirm that they have maintained e-mail going back to the beginning of the administration as they are required by law to do," said Melanie Sloan, executive director of Citizens for Responsibility and Ethics.

1. CREW also has a case asking for WH visitor logs which have
been declared Classified. CREW was looking into who was visiting the WH during the build up for Bush's War. Interesting that.

I think Melanie Sloan said CREW was interested in what religious leaders were advising Bush Inc. during that period.

6. Likewise for Cheney. Both religious leaders and Energy Execs are of interest.
This goes all the way back to the first 100 days when the Energy Task Force was meeting in secret.

In response to CREW's lawsuit over access to what should be public records, we learned that Vice President Cheney's lawyer told the Secret Service that visitor logs were his records, not theirs. That meant Cheney could prevent any public access. Before you read the AP article, know CREW's position according to our counsel, Anne Weismann: "The latest filings make clear that the administration has been destroying documents and entering into secret agreements in violation of the law."

A lawyer for Vice President Dick Cheney told the Secret Service in September to eliminate data on who visited Cheney at his official residence, a newly disclosed letter states.

The Sept. 13, 2006, letter from Cheney's lawyer says logs for Cheney's residence on the grounds of the Naval Observatory are subject to the Presidential Records Act.
