2. Thanks for this, kpete! The footnotes, yet again, tell the tale

I have not finished reading Judge Walton's opinion, I am having trouble seeing with the tears of laughter in my eyes, lol, at this comment in the footnotes found on page 4 of 30:

"This "Talmudic dissection" of the Court's word choice and phrasing..."

Judge Walton does, indeed, have a way with words that cuts like a knife!

Edited to add:

Footnote re Scalia's dissent opinion is a must read, Judge Walton is, shall I say "succinct" in his note, especially in his final sentence in this footnote which says:

"The court does not, and need not, attempt to reconcile this conseivably contradictory language."

This foot note is found on page 10 of 30.

I just had to edit this in, it is a keeper, rofl!

On pages 12-13, Judge Walton writes the following in the main body of the opinion:

"The defendent substantially overstates the plausable breadth of the authority granted to Fitzgerald by the Comey letters. They do not confer upon Fitzgerald as Special Counsel the prosecutorial equivalent of James Bond's license to kill..."

6. I have to say my respect for Judge Walton increases with every
opinion he puts forth. His footnotes are something to look foward to for sure but the main body of his opinion is very worthwhile as well. I hope you keep trying to load it, it is worth it, imo. I am also looking foward to Fitzgerald's response to the Libby defense submission as well.

7. And just think! Walton is a Pubbie!
There are probably quite a few of them around who also respect the rule of law. Sure wish they'd come out of the closet.

8. He's talking to the future appellate court justices - setting the bar high for an overturn.
Nice.

do you really think Libby isn't going all the way to SCOTUS if he loses in the other appeals?

what do you think is going to happen there?
