There wer 63 yeas, 34 nays, and three not voting (two were likely yeas). Only Casey and Nelson on the Dem side voted nay.

With an election year staring them down, a lot of RRRs will be vulnerable on this very issue. It's highly unlikely to hurt any Dem to hold their position on an override.

Here's the Senate vote. Even one of my loathesome Senators (the ever-creepy John McCain) voted yea.

Let's show the bastard this time. Call your Senators, please.

Edit: Link to the vote on 4/11: http://www.senate.gov/legislative/LIS/roll_call_lists/roll_call_vote_cfm.cfm?congress=110&session=1&vote=00127

1. the problem is the house -- well short of override numbers
The bill passed the House by a vote of 247-176 -- well short of the number needed to override.

2. With an election year approaching, that may be vulnerable.
The American people want this legislation and if we make it stink, we may win.

3. an override failed in 2006 -- just months before the election

Changing forty votes is pretty much impossible, I'm afraid. I can't think of a single time when anything close to that has happened.

I'm not saying the effort shouldn't be made. It absolutely should. But realistically, it almost certainly won't succeed.
