2. ... The mother, Christine Porcaro .. did not return telephone messages seeking comment ...
Pancol’s order .. said there was evidence that Scarberry .. at times “failed to control or manage his anger. ... In addition, (Scarberry) was sending a great number of text messages to (Porcaro)” ... Percaro had obtained a protective order against Scarberry, which .. alleged .. “attempts to harrass and intimidate me at my place of employment with abusive language and profanity” and accused him of “randomly and unexpectedly stopping by my house at different hours of the day and night” ...

4. The Court Order, please?
I want to read the court order myself, and see the language that pertains to a judgment based on religious principles.

5. Feel free to knock yourself out with a websearch, and tell us what you find
I posted what I could locate easily. I think family court type stuff generally isn't online, but you might find it somewhere. Divorce and child custody fights are often often ugly, with accusations and counter-accusations. I would expect the folk, who have to make recommendations or issue decisions in such matters, sometimes bring their own experiences, prejudices, or views to the process

3. Dangerous precedent
What would then stop a judge from abrogating custody rights because the parent is a Protestant, Catholic, Jew or Muslim?

6. Its been reported he's been harrassing the mother and got into physical altercation

with mom's boyfriend. There's more significant things going on here than religion. The restraining order is worisome.

10. Question then would be: WHEN did his harrassment start?
If it was after she sued for a change to the custody arrangements, because of his change of religious heart, then I would find his actions understandable. STUPID, (and quite possibly wrong, depending on how far he took it) but certainly understandable.

12. The operative word here "wrong". And nothing in the record says religion. It does say he engages
in angry swearing in front of the kids, but mom and boyfriend aren't. He engages in unannounced visits to her work, she doesn't stalk him. He leaves too many rambling messages and e-mails, she doesn't. He's engaged in fisticuffs with the boyfreind at her house after using his car to intimidate the boyfreind when they had joint custody. A judge issued a restraining order against him, not her. And this is about religion?????????

To put this into perspective: I was the custodial parent of my children and my ex-wife and her boyfreind were in the picture. I found out that all the stuff I heard from single mothers that I used to make fun of were coming from my mouth. I am also ex-Navy. I want to support him. But the facts do not favor him. He's very angry and he's his worst roadblock. He needs to get a little anger management help. And admit, this is not about religion. It needs to be about the kids.

13. The altercation with the mom's boyfriend was started by the mom' boyfriend by his
own admission.

Admittedly, dad should not have engaged with said b.f., but I can understand. This man (b.f.) was interfering with a father and his children. As a mother (and a stepmother) I understand the father's feelings.

The way we do divorce and custody in this country is a travesty. Mediation, not court battles, should be the norm in this country. Bring the parties together to agreement, not an adversarial process.

9. Is this the same Craig Scarberry from Indiana who was suing Chicago for the right
Edited on Sat Nov-27-10 09:31 PM by struggle4progress
to hand out Bible tracts for Repent America?

... Plaintiffs intend to return to Chicago on a number of future occasions to engage in constitutionally protected religious and political activities in public settings ... Plaintiff, CRAIG SCARBERRY, is and was at all times relevant to this cause, an individual and resident of Indiana. Plaintiffs are volunteers for Repent America, a volunteer-based ministry in Philadelphia, PA, which is composed of approximately 10,000 Christians who live across the United States. The goal of Repent America is to proclaim the Gospel of Jesus Christ in the public square ... Plaintiffs are Christians who regard the Bible as God’s literal authority ... Plaintiffs accomplish this purpose primarily through the public distribution of free religious literature (“Gospel tracts”) and one-on-one discussion in the public square ...

11. Calling bullshit.
Dad is CLAIMING that is why. Which is a far cry from it actually being the case.

This decision was based on something else, guarantee it. I find it hard to believe any sitting judge would be that stupid.
