1. Lying to a woman in order to get her to have sex with you is rape?
I don't think we have enough prisons to lock up the entire male population.

3. you know on the one hand I'd as a male be offended
but then listening to just how broad this woman thinks "any information" is, I would have to guess that at some point I have lied about something that had some part to play in a woman having sex with me.

So I guess lock me up then...at least I will have company.

Lots and lots of company. And probably, a good portion of the female population will be there too.

2. I'll give her the benefit of the doubt
that she isn't being racist and this is really just a MEGA extreme position on what constitutes rape.

By her definition, anyone who gives wrong information to get sex is guilty of rape.

So, if I say I love you baby, and it turns out I don't really love you, I just like you, well, that was wrong information, and I am guilty of rape.

If I say I have a good credit rating but it turns out my credit rating is just ok, then I am guilty of rape.

You know, if I pretend to a sleeping woman that I am her husband/boyfriend in a dark room, that's rape by deceit. Telling her I am Jew when I am Arab is not rape by deceit. It may be a jerk thing to do, it certainly is a lie, but it ain't rape.

16. I think you are being too generous. Notice how she avoids to answer the question?

It was legitimate to raise concern that there might be a racial factor in this. It would have not cost her anything to say "Yes, absolutely, we would treat this the exact same way if a Jew had done this to an Arab woman." Instead she proceeds to talk about generalities. But she does not fail to mention that "Arab men have also been doing this to Arab women".

4. If she wears a padded bra, can he charge he with "rape by deception"
for luring him to bed with the promise of big tits?

This is nothing more than Faulkner's Absalom, Absalom brought to life. Story of a very light (i.e. white) man who is found to possess a drop of Black blood and who gets killed by his white fiancee's brother. Ain't dualism great?

5. As a woman
Edited on Wed Jul-21-10 03:32 PM by drmeow
I'm really concerned about this. By broadening the definition of rape to allow someone to essentially retroactively withdraw consent and have that count as rape diminishes what I would consider real cases of rape and has the potential to damage the legitimacy of organizations which are fighting to stop rape.

I also can't help but feel that if it was a married Jewish man who claimed to be an Arab bachelor and had sex with an Arab woman, it wouldn't have even reached the courts let alone resulted in a guilty verdict.

If the sex was really bad, can I claim I was wronged sexually? If I didn't have an orgasm, can I claim I was wronged sexually.

Now, if he'd gone through a false marriage ceremony with her because that's the only way she'd have sex with him ... that might be different (and that breaks a number of laws).

I'm sorry if this women felt hurt and upset ... but the psychological harm from "he lied to me and now I regret having sex with him" is not comparable to the psychological damage from rape.

7. that's a pretty valid concern
you do risk minimizing rape by over-broadening it and probably help perpetuate stereotypes about women and rape with this kind of an argument.

Thankfully, I just don't think, hope, that most advocates on this side of the ocean would make these kind of arguments.

I mean there is an actual subset of rape by fraud in American law but it's a very narrow, and logical set of circumstances to invoke it.

8. I would imagine
Going through a false marriage ceremony with her because that's the only way she'd have sex with him (as I edited my post to add) might qualify as that ... and that I could see.

9. well the law contemplates
the rare, but it's happened believe it or not, occurrence where someone has snuck in to a women's bedroom and pretended to be her lover, and she's "consented" because she believes she is having sex with someone else (her husband, boyfriend, what have you).

I don't recall anything that points to a false marriage ceremony. I don't think that would qualify under American law but it would be closer (and of course a pretty messed up and evil thing to do).

11. Oh, right. I hadn't thought of that
there are other laws that someone is breaking with the false marriage thing ... and the rape aspects certainly gets used with underage girls (as in the Warren Jeffs case). I don't know if you could get a rape conviction in an adult case like that (probably more likely if she was a virgin) but my guess is you could get civil damages (of course, that assumes the money to pay).

6. Whatever happened to "buyer beware"
There's a legal term for this, I believe...what is it...oh yeah, "this is fucked up." Literally. But it's the man's fault---he used the defense "I thought she was a good lay but she was a cold fish. I've been lied to." Two wrongs don't make a right.

10. Sounds like the conditions of the courts and justice suck
(no pun intended) in Israel too.

I hope we don't become as crazy as they are.

This man convicted for false sex is if she were a whore and money were exchanged.

hilarious and on display. I guess lying to somebody is now a violation. Well in that case, FOX News has been raping America for many years now.

14. People have the right to be choosy about whom they trust.
If someone is looking for a long-term relationship, it is their right to demand respect from their suitor, and to want that suitor to be trustworthy.

Lying to someone to get them into bed is profoundly disrespectful and deeply selfish. It betrays the values of the deceived. The deceived might as well be a fleshlight or a dildo, because they are being used solely for the sexual satisfaction of the liar. (I'm talking about the big lies, like pretending to be single while married, or pretending to want a long-term relationship when there is no intention of following through on that.)

People who regularly lie to get laid are getting their sex from the wrong source. They should find a more willing source of partners, including hiring sex workers. As ugly as prostitution can get, at least it is honest about what both parties expect from the transaction.

"That said, it is batshit crazy that this is considered rape in any quasi-civilized society."

There..I said it for you.
