The distinctions between manslaughter and murder, consists in the following: In the former, though the act which occasions the death be unlawful, or likely to be attended with bodily mischief, yet the malice, either express or implied, which is the very essence of murder, is presumed to be wanting in manslaughter.

5. Manslaughter is not very complicated. It is best described as

an unintended death resulting from an illegal act.

The best real life example is in a neighborhood that was plagued with speeders racing through after the high school let out. The speed limit was around 25 mph but cars speed through in excess of 60mph. After the city rejected the homeowners pleads for speed bumps a couple of home owners decided to put their own speed bumps in.

Their intention was to slow cars to a safe speed to keep everyone safe. That is not what happened. A car traveling at high speed hit the speed bumps and the driver lost control. The car rolled and a person in the car was killed. This is manslaughter. The people that put in the speed bumps did so illegally. They did it with the most noble intentions but a person died as a result of their illegal actions.

Very tragic, but it is what it is.
