On-Demand Audio Program Examines The New Obama NLRB

The Obama NLRB: What Employers Can Expect from the New Board is the subject of a 64-minute audio on-demand program produced on May 21, 2009. It is sponsored by the West LegalEdcenter and presented by Jeffrey S. Bosley, partner, Winston & Strawn LLP; Michael Eastment, executive director of Law Policy, U.S. Chamber of Commerce; and William J. Mateikis, visiting professor of law, Wayne State University.

The election of President Barack Obama has already resulted in a new National Labor Relations Board chair, and his recent announcement of nominees for two open positions puts the NLRB on target to be at full strength for the first time since December 2007. The new Democratic-majority NLRB will provide guidance on issues important to both union and non-union employers, including: access by unions and union organizers to employer and private property; whether individuals are independent contractors or employees under the NLRA; the vitality and scope of the board's Dana Corporation decision concerning voluntary recognition of a union; and whether it is legal for an employer and a union to agree to conditions for a potential bargaining contract in a pre-recognition neutrality agreement.

A panel will discuss the legal and practical impact of these and other issues pending before the NLRB, including how future decisions will impact union organizing drives and current and future bargaining relationships.
