SAN DIEGO — The California Labor Commissioner is working to shut down a carwash here for failing to properly register with the Labor Commissioner’s Office, according to a press release.

The Dec. 30 press release said Commissioner Angela Bradstreet has filed a lawsuit against Choufa Holdings, Inc. dba Action Car Wash after it failed to register as required by California Labor Code section 2050.

“This is the second lawsuit filed this year against carwashes that continue to illegally operate without a registration. I want to send a clear and strong message to the carwash industry that this is unacceptable,” Bradstreet said in the story.

The California legislature passed AB 1688 in 2003, which set up a registration system for all carwash and polishing businesses, and is known in the industry as the Carwash Worker Law. The law, which is found under the Labor Code Sections 2050-2067 was set up to protect employees. Professional Carwashing and Detailing wrote about the state of California and its carwashing laws in the September 2008 cover story.

“Illegal cash pay, child labor violations and failure to provide workers’ compensation to their employees are some of the common violations found in the carwash industry” Bradstreet also said in the story.
