1. I thought the Repub party could pick who will run since DeLay
Edited on Tue Apr-04-06 11:59 AM by CottonBear
resigned after winning the primary? Did the Texas GOP change the rules midstream in order to allow a special election? If so, why?

2. The special election would be to fill his vacancy in the House
That person would serve out the remainder of his term, from his resignation until 12/31/06. The local repub officials do get to name his replacement on the ballot, however. And that might or might not be the same person- who knows with these people?

8. I'm confused. Is the replacement chosen by election or appointment?
Sorry I'm so dense. :)

9. Both
Sorry to confuse the subject even more! His replacement *for the remainder of his term* is chosen by special election, his replacement *on the ballot* is chosen by party officials. And that might or might not be the same person, depending on whether the party favorite wins the special. Hope that helps! :)

4. Here's a snip from the link I posted.
According to Chapter 204, Subchapter B. of the Texas Election Code regarding a vacancy in the U.S. House of Representatives, “An unexpired term in the office of United States representative may be filled only by a special election in the same manner as provided by Chapter 203 for the legislature….”

According to Chapter 203, ...”a special election shall be held on the first uniform election date occurring on or after the 36th day after the date the election is ordered.”

The first “uniform election date” falling within that range appears to be the May 13 elections, assuming Gov. Rick Perry orders a special election within the next three or four days.

Yes, I noticed the last line too, and i guess we'll just have to see what Perry does.

5. Sorry, I assumed all would know that since he's the Tx. Rep and
no longer Majority leader.

11. Ooooo, I sure hope you're right! IF, and in my mind it's a big if,
DeLay really did resign because he thought that would keep the seat Repuke, that would be such beautiful poetic justice! And after all that aggrivation he went through redistricting and all!

12. How utterly stupid.. a special election for a seat with 5 months left?
and a gigantic waste of money.. When someone leaves their house seat, it should automatically go to the one they "defeated" in the previous election...or remain empty until the next election (if it's less than a year away)..
