Before tomorrow's censure hearing, watch VIDEO of the FISA Surveillance
Hearing from Monday. I have put a number of selected clips on journal

You will get a feel for this how FISA judges consider the matter (Washington Times misrepresented what they said), understand the difference between Specter and Dewine's bill (and it's a big diff) as well as see some Dems clarify whether the President can ignore statute. My favorite clip is one in which Specter turns to Hatch and sayd "Senators are not judges".

4. I got the impression that the judges said that Bush could ignore statutes
...if they override his inherent power, and that FISA seemed to qualify.
But in other clips, they said he is bound by FISA and ignores it "at his peril".

Those judges were all over the map on the issue, and were avoiding soundbites with all their might.

5. One judge, Kornblum, seems to have been invited by the Hatch/Dewine
bunch. The bottom line as I heard it from ALL the judges is that a court would decide this issue. And that's the central problem with DeWine's bill versus Specter's, that under DeWine's NSA would report to CONGRESS rather than taking it to a FISA court first.
