Published: Friday March 24, 2006


Former House Majority Leader Tom DeLay has lost his right to carry a concealed handgun in Texas, RAW STORY has learned.

A Texas website that insists it is not a blog, Brazosriver, was the first (to the knowledge of RAW STORY) to post a judge's order to suspend DeLay's license. Under Texas law, indicted felons are not allowed to carry concealed handguns.

Attorneys for DeLay plan to appeal the order.

7. On the Texas CCW application (form 4473)
One of the questions asks if you are under felony indictment.

If the answer is "yes" then that is grounds to deny a permit under TX law.

If Texas was a "may issue" state then the final decision would rest with the Chief LEO in Delays district or the county judge.

In "shall issue" states you either qualify for a permit (you meet the criteria as laid out by the law) or you don't. In may issue states permits are distributed at the discretion of the issuing agent (usually the Chief of Police or county sheriff).

Thank god Texas is "shall issue".

out of the 47 states that allow CCL (Kansas just passed a law over the governors veto yesterday) 36 states are Shall issue and 9 are may issue. Alaska and Vermont require no licence. In those nine states, if Tom Delay was a resident, he would probably still be able to keep his licence because of his political power and connections.

52. Yes. Texas has a "shall issue" CHL law (like most states)
meaning the law sets forth objective criteria by which you either qualify for a CHL or you don't. One of the provisions is that you cannot have a CHL if you are under felony indictment. You can still own guns (until convicted), but you can't carry one on your person.

If he is convicted, he will lose his right to so much as touch a gun, or a single round of ammunition, for LIFE, with no possibility of appeal (unless somebody pardons him). Any conviction for a felony (even writing a bad check to a restaurant), or a misdemeanor involving domestic violence, carries that life penalty.

felon, because you can't be an indicted felon, you can only be indicted for a felony.

Once you are convicted, you are a felon, before that you are still presumed innocent, even if you are a slime like DeLay.

That's what the justice system is based on, the presumption of innocence under the law.

So there is no way that associating with him would do anything but get slime on the person associating with him.

After that, unless you are a convicted felon, there probably isn't any law that says that you can't associate with a known felon either.
