Lack of Jail Space Prompts Early Release for Kubby

Medical marijuana crusader Steven Kubby is out of jail after serving just a third of his 120-day sentence for drug possession. Placer County officials said they had to let him out early because they don't have enough room in the jail.

Kubby's arrest on drug charges after 265 marijuana plants were found growing in his home made headlines, but Kubby was acquitted on charges of marijuana cultivation for profit. However, he was later found guilty of possessing small amounts of peyote and psilocybin mushrooms. In December 2000, he was sentenced to serve 120 days in the Placer County Jail.

Claiming a jail term would prove fatal for him, Kubby failed to appear to begin his sentence. He contended he couldn't survive without daily marijuana therapy, which he uses to treat adrenal cancer.

Kubby moved to Sechelt, British Columbia, in part to avoid going to jail. He and his wife Michelle served as co-anchors of the Internet based Pot-TV News.

sheriff joe has made sure that no one will go free for lack of space even if he has to build tents all the way to the mexican border.

he does do some good things. he took prisoners out of the air conditioned jail and put them in tent city to make room for pets from the katrina tragedy.:eyes:
