At what point will the Katrina "missing" be considered dead?

At what point will the Katrina "missing" be considered dead?
I keep hearing "1,300 dead, 2,300 missing" with the new videos that came out today. I'm wondering when the search for these missing people will end, does anybody know the protocol?

6. Remember how after the WTC bombing everyone was just plain ol' dead.
Folks were plain ol' dead. No one was 'missing'. First we heard 5000, then the number stabilized to just below 3000. With Katrina, you weren't dead until you showed up at the coroner's office, knocked on the door, and held up a card that said "HEY! I'M DEAD!" And even then, they'd try to tell you that you died of heart failure or drown in the bathtub.

11. What are the legal ramifications for the families of the "missing"?
I would be very interested in knowing whether the relatives of the Katrina "missing" are finding themselves unable to collect life insurance payouts or, in the case of kids whose parents are missing, Social Security payments. Could that be one reason they are still considered missing, rather than dead?
