How vile and disgusting does he have to get before Rush is sued?
Pigboy got a call from a listener who wondered what the Dems would do in the Tim Johnson case considering the "precedent" they set in the Terry Schiavo case. Rush said that was a good point, and then heading for a break said; "Here's the bottom line folks, if Dingy Harry needs to keep Tim Johnson on a respirator for two years to maintain Democrat (sic) control of the Senate, that's what he'll do".

First, I would love for Harry Reid to get just a few minutes alone with Rush in a locked room.

Second, any legal experts know how far a scum-bag has to sink before he can be sued? I kind of understand that public figures are fair game to a certain point, but hasn't Rush passed that point a few hundred thousand times? How his statement, and that's word-for-word, does not reach the level of slander or defamation of character is beyond me.

1. They can keep lowering ladders
Where public figures are concerned, there's virtually no basement. New York Times vs. Sullivan and its Supreme Court progeny establish that a jury must find "actual malice" in order to find in favor of a plaintiff in a case such as you envision.

Most public figures shy away from such cases because it's most often a matter of "the more you stir it, the more it stinks."

Ultimately, though, "actual malice" remains a question for the jury.

2. Being disgusting isn't a crime
If he slanders someone inaccurately, or he incites illegal behaviour, he can probably be sued. Anything short of that is legal, I believe.

I think it was Justice William O Douglas who said that the measure of free speech is how tolerant we are of the most vile and disgusting speech. If you want to be able to criticize the President, you have to let Rush say whatever he wants. Just don't listen!

He makes me so sick to my stomach, it's doubtful I'd be able to listen for more than 30 seconds.

I always wonder how DUers can put up with listening to people like Limbaugh, Hannity, O'Lielly, Imus, Coulter, Malkin and other FAUX News hoes.

I can BARELY deal with Tweety, and I mean barely!!

Rush Limbaugh Detained With Viagra

(CBS/AP) Rush Limbaugh could see a deal with prosecutors in a long-running prescription fraud case collapse after authorities found a bottle of Viagra in his bag at Palm Beach International Airport. The prescription was not in his name.

Limbaugh was detained for more than three hours Monday at the airport after returning from a vacation in the Dominican Republic. Customs officials found the Viagra in his luggage but his name was not on the prescription, said Paul Miller, a spokesman for the Palm Beach County Sheriff's Office.

Miller said the alleged violation could be a second-degree misdemeanor. The sheriff's office was investigating and will soon turn the case over to the state attorney's office, which had no immediate comment Tuesday.

Under the deal reached last month with prosecutors, Limbaugh was not to be arrested for any infraction for 18 months in exchange for authorities deferring a charge of "doctor shopping." Prosecutors had alleged the conservative talk-show host illegally deceived multiple physicians to receive overlapping painkiller prescriptions.
