Romney To Ask Judge To Force Mass. Lawmakers To Vote On Marriage Amendment
Boston, Massachusetts) After saying there was nothing he could do when Massachusetts lawmakers postponed a vote on a proposed amendment to ban gay marriage Gov. Mitt Romney said Sunday he will go to court this week to ask a judge to order the Statehouse back in session to deal with the issue.

Speaking at a rally of conservative Christians in front of the legislature Romney said lawmakers were cowardly for putting off the vote.

"A decision not to vote is a decision to usurp the Constitution, to abandon democracy and substitute a form of what this nation's founders called tyranny, that is, the imposition of the will of those in power, on the people," Romney told the several thousand people gathered in front of the Statehouse Sunday.

"The issue now before us is not whether same-sex couples should marry. The issue before us today is whether 109 legislators will follow the Constitution."

Correct me if I am wrong, how can the courts make the Legislature vote? Wouldn't' that be considered a separation of power thing? I know Mitty boy is throwing a temper tantrum over this issue, and if the Courts did intervene I would suggest a sick out. No quorum no vote. I am wrong in my thinking?

7. This is the most obvious example that an activist judge is only one
who does something the Right disagrees with. If they are doing something they want, even if it's being done to circumvent the political process, then the judge isn't being an activist.

I wonder if he has a specific judge bought and paid for.

Absolutely separation of powers...

Years ago when I was activating against Term Limits in Massachusetts, the governor then tried to force the legislature to vote on a proposed amendment and the legislature - sitting in Constitutional Convention - refused to take action.

That is a wise precaution against stupid ballot initiatives, as this anti-gay measure certainly is.
