Google is destroying YouTube!!! But it's not all bad..
Ever since they bought YouTube, The Daily Show and The Colbert Report videos have started disappearing, and the people who had the most Daily Show and Colbert Report clips, have started getting their channels suspended or just had all their videos removed. :mad:

O.K., that's not entirely true. First Google bought YouTube and everything was fine, but then, a few days later, Stephen Colbert, on his show, in his "ReThug Stephen Colbert" persona, mentioned the sale and how, since there were something like 2300+ Colbert Report video clips on YouTube, that he was RICH! Because, he said, that's something like 10% of all the videos on YouTube (probably not true) so that meant that YouTube owed him 10% of that $1.56 Billion Dollars, or something like $5 Million Dollars. I think he was joking, though I'm not totally sure.:shrug:

So the next day, I started noticing Daily Show and Colbert clips disappearing. Then some of the Classic, politically important and very hard to find Daily Show clips that I had uploaded there, started getting randomly rejected, supposedly for copyright infringement. These were not new clips or clips that are available on any DVD or VHS tape that Comedy Central is, or ever was, selling on-line of in stores, they were from 2 to 5 years ago, that had been up for months, that started getting "rejected." Mostly they are clips that contain video that is Historically significant Political News and/or politically embarrassing (for Republicans). The politically embarrassing clips were the first to go.

So, I feel, Colbert's speech (joke?) on his show the other night, has either freaked out the lawyers at Google/YouTube, so are scrubbing YouTube of any clips that even MIGHT invite a lawsuit, or Colbert's speech was a "The Parties Over" notice to his fans at YouTube.

The problem is, the people who argue "Delete them ALL, they are Pirated video..." and claim that the Copyright Law is very clear about this are very wrong. The Copyright law is very unclear when you also take into account the "Fair Use" clause of the Copyright Law, something the "delete 'em all" folks almost never do. Hell, if you read the copyright law selectively, like the previously mentioned crowd does, most of what is on YouTube would infringe on somebodies Copyright in one way or another, so YouTube would be dead within months.

Either way, it Really Sucks! I could go into it further, but what's really important is the news I posted below.

Also, I would guess that The Daily Show and Colbert fan traffic is a BIG chunk of YouTubes' daily hits, so if any of you hold any Google stock, you might want to keep an eye on it's price.

There (their?) are hundreds of Classic and New Daily Show and Colbert Report videos at an almost identical (it uses the same technology) and just as well known site, but their videos section is a much less well know part of this site, and their TDS and Colbert clips get much less traffic than those on YouTube did. It does seem a little bit slower when posting the videos though.

It's MySpace's video section.

I know, MySpace is owned my Rupert Murdock, but I've been on MySpace for 2 months now, and I've yet to see any Murdock influences.

And Check this out! I was going though the The Daily Show videos, just now, and found one of the BEST EVER clips!

Some of you might remember back, during the The Daily Shows week of coverage of the 2004 RNC convention, when Stephen Colbert interviewed Porn Star Mary Carey and her Producer from "Kick Ass Video" Mark? Remember the Pizza?

Well I found that video and it was posted BY MARK! The Porn Producer! Remember, he was the guy who paid the RNC a certain amount of money and was given some honorary title from the RNC!

Anyway, I don't want to give away too much for those who never saw it, but here's the link:

NOTE: If any English Majors out their could look over this message send me a kind note about if I used the proper forms of the word "There" and "Their," I had a lot of trouble in school with my English Grammar, and have forgotten the rule for that word, but would like to improve my English grammar.

2. Google's acquisition of YouTube........
spells the end for it. They'll destroy it, turn it into another Corporate propaganda "fun site" then write it off their taxes when it's dead.
Others will pick up the slack, though, most hoping that THEY'LL strike it rich when Corporate hucksters set up the 'two-tiered' internets. It's all about the money. No one can just have fun anymore, it's all about the money. Sad, truly sad.

Yahoo! spent billions for it and then basically shut the site down. It didn't make any sense to me.

"Their" means "belonging to them."
"They're" is a contraction for "they are."

12. But YouTube *IS* stealing from him.
When YouTube redistributes video from The Comedy Channel
without paying anything to the Comedy Channel, that is the
theft of CC's intellectual property and CC (and, in turn, Jon
Stewart) get *NO* money for their work.

There's no other way to view this.

..."in Character" of an obnoxious, egotistical, RW Jerk, so was he joking? I'm a 10 fan, and even I can't say for sure.

It's funny, but the people who *OWN* the intellectual property
somehow expect the laws regarding I.P. to be respected, and
some of them have enough money and lawyers to take on
even Google.

YouTube has clearly been on the wrong side of the law for
a long, long time; convenient for us, but still illegal.

There is a solution, of course: Just get the content producers
(such as The Comedy Channel) to release their I.P. for free
redistribution; "Good Luck!".

14. I think when the choice is between hiring a $300.00 per hour Lawyer...
...and paying some intern or Entry-level worker at Google $5.15 - $8.00 per hour to search and destroy any questionable video clips, I'm sure most Corporations would do the same thing.

In the auto e-mail that goes out with these deletions, it does say the following:


...If you elect to send us a counter notice, to be effective it must be a written communication provided to our designated agent that includes substantially the following (please consult your legal counsel or see 17 U.S.C. Section 512(g)(3) to confirm these requirements):

(A) A physical or electronic signature of the subscriber.

(B) Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

(C) A statement under penalty of perjury that the subscriber has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

(D) The subscriber's name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of Federal District Court for the judicial district in which the address is located, or if the subscriberis address is outside of the United States, for any judicial district in which the service provider may be found, and that the subscriber will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person....

Etc.


I most cases, it just not worth the time and/or money to challenge this, but it sure is an easy way for people of opposing political views to control how people remember history.

who posted the challenged material had *NO RIGHTS TO IT
WHATSOEVER, AND IS LIKELY TO BE CRIMINALLY LIABLE
FOR A VIOLATION OF THE COPYRIGHT LAWS* and knows it.

*THAT* is why people roll over when they get one of these letters.

28. You probably need to update your Flash Player software...
...that's what the engine is behind YouTube, MySpace, iFilm, etc. video sites. Here's the link: <http://www.adobe.com/shockwave/download/index.cgi?P1_Prod_Version=ShockwaveFlash>

It could be your Firewall settings too. I have to switch to the WindowsXP firewall and turn off Norton's Firewall in order to see the thumbnail pictures at MySpace Videos.

If that doesn't work, turn off any Pop-up blocker, if you have one on, as far as I can tell, MySpace doesn't have any annoying Pop-up Ads, but a lot of Video sites like this do need to have Pop-ups set to off to work.

I think your "fair use" point has some validity, but it doesn't apply to the case at hand.

Absolutely, you personally have "fair use" rights to use John Stewart videos (for example) for all sorts of purposes. Among the things traditionally protected by "fair use" are excerpts for purposes of criticism, education, review, etc.

However, your "fair use" rights do not transfer automatically to YouTube. In other words, just because you have a "fair use" right to certain uses of the material, does not mean that YouTube has a "fair use" right to host that material.

...like making Daily Show videos available only in private groups, that would have to be joined and would not allow advertising?

Personally, I think Comedy Central could solve this by setting up their video viewing area better, I have NEVER been able to get their stupid new "Motherload" video player to work on any of my browsers.

Even if they didn't let people upload videos, if they had all or at least Most of the videos from ALL of the years, (and not just the last year or two) and had a similar system for fans to comment and rate the video, they would gain traffic, rather than drive it away, like their "Motherload" player is doing.

Btw, I found a "back-door" to about 5-6 years of The Daily Show videos (and just about all of their other shows too) at Comedy Central, which uses the the old Windows Media Player format, for those, like me, who can't get the "Motherload" player to work.

I don't know why they hide this link, because the videos are current.

22. NOOOO!!! The post 9/11 Daily Show is gone!!
That was one of the best and the most heartfelt Jon Stewart we ever saw I think in the first show after 9/11. I had it on my favorites and it is gone now :(

23. I would think Stephen Colbert was kidding
since he doesn't have anything to lose (I don't think?) by people watching his videos on youtube. And he does like to promote his show.

And, I'm guilty - I've spent several hours at youtube watching old TDS and Colbert clips. I'd guess you're right about it being a big chunk of their traffic, especially for those of us who discovered them late.

The Jon Stewart video when he first came back after 9/11 made me cry, and so many others made me laugh - I'm sorry to hear they're taking them off, although I admit I did worry when Stephen mentioned it. I'm glad to know myspace has a collection - thanks for the post!

32. I'm not completely sure, because their search engine is a little odd.
I'm not sure if those are 2609 clips that are still available for viewing.

I did a search right after he said that and about a day ago and, I'm not 100% sure anymore, but I could have sworn that I got something like 60,000 hits right after he said it and then, like you say, something around 2600 now. But I think if you click on a lot of those, they go to a page that has a red box at the top that says "Video removed for Copyright Infringement."

Either way, this is happening, it's not any sort of tin-hat theory. Here are two of the Channels that I would goto to see lots of Daily Show videos, check out the comments section to the lower left on the page linked below:
