Foley may be charged if he and the young man engaged in sexual activity, though the case may be dismissed because of the page's close proximity to the age of 18. (However, there are numerous circumstances throughout the country when very conservative ages of consent have caused 18 year olds to be prosecuted and imprisoned for sexual activity with a minor. In this case it is more likely Foley would be charged because of his age at the time of any contact 51.)

There are strong indications that this page was given alcohol by Foley, that would be contributing to the delinquency of a minor, because the page was well under the legal age for alcohol consumption.
