2. Remember that the SCOTUS has to decide
Whether or not it's constitutional, not whether or not it's wrong. I'm not an expert on the US constitution by any stretch of the imagination - is there anything in it about the treatment of non-citizens in jails?

4. I am hopeful
that the Supreme Court will eventually strike this law down. It is definitely unconstitutional to do away with Habeus Corpus except during insurrection or invasion, neither of which apply to the current situation. However 7 of the 9 justices are now Republicans so we can only hope that they will do the right thing. I hope, I hope....

8. But Bush can pretty much define what is an insurrection now
It could be as simple as an anti-war protest. One of the protesters was brown and carrying a knapsack so we had to microwave the whole crowd.

the SCOTUS will not open the US up to war crimes charges

This bill allows legal cover for America and the SCOTUS will not blow that cover

Now, years from now, some future SCOTUS might rule it unconstitutional...after the damage has been done..and then an apology for past "mistakes" (America's favorite euphemism for crimes) will be issued...but the apology will be as far as it goes.

7. No, their first ruling was just a precursor to this
and included the curious language about congress legislating this if they want it to go forward IIRC. The cronies will come out in full force for this one and rule it constitutional.
