Both sides. Neither dems or repubs want to go home to their constituents and face the "soft on terror" meme. So they're going to vote this through simply to cover their asses for their campaigns, not provide any fodder to the other side, and then hope like hell the SCOTUS tosses the whole mess out afterwards. I seriously cannot believe there are this many people in our government who are in favor of turning the nation into a dictatorship. I just can't believe it. I think they're ALL just hedging their bets instead of just doing what is right in the first place.

2. There are pending habeas cases

that will be dismissed under the new law when it goes into effect. Those detainees whose cases will be subject to dismissal can challenge the court-stripping, at the very least.
