Bush wants article 3 changes to be retroactive, media ignoring this fact
except for Olbermann but i did miss Democracy now last night and i bet that didn't escape Amy. Does this seem to be more egregious than other things he's demanded or is it just me?

So lets hope that Warner and the others hang tight and don't give him what he wants so when the detainees that just got moved to GITMO will tell the Red cross what was done to them in those secret prisons, lets hope Bush doesn't get his "Get out of jail card"

1. That is part of the reason he is so desperate to get this legislation
He needs to save his sorry little ass from jail and he knows it.

most of these congress critters are lawyers and know the legal code, I don't think they're
going to be too anxious to move from the House to the "Big House" aka the "Slammer"

That's really the main point of the legislation. Bush tells us that if we don't waterboard all those Terr'ists, they'll come and kill all our children, but that's bullshit; what's got Bush's panties in a twist is the fact that they've already done a whole lot of bad shit to a lot of people -- some of whom will be spilling the beans before long -- and that this bad shit is illegal NOW, no matter how you interpret the Geneva Conventions. So as the law stands now, somebody will be subject to prosecution for war crimes. Once he's out of office, what's to prevent him from having his sorry ass hauled off to The Hague? He's got to be worried -- I think his anger and agitation at recent press conferences is evidence of that.

7. Jonathan Turley was on Olbermann last night and he said he thinks
that when the detainees that just got moved start talking to the red cross it's going to be ugly and that why Bush is bringing this up now, he said he thinks the WH knows somethings coming.

10. I think Turley hit that supposition out of the park, frankly. Right on
the money. They've got to make these crimes they've been committing "non-crimes" and toute suite, chop-chop, straight away.

11. me too, i hadn't really thought about that angle until i heard him
i should have read my paper a little more intently when this story first started breaking the other day. It's maddening that he uses so much bullshit and bluster and jingoism all in the name of covering his ass.

16. An attorney told me Bush would not be able to make the changes
retroactively. It's unconstitutional.

It's prohibited because if a person commits a crime, they are tried based on the laws in place at the time of the crime, not laws enacted or changed later. Bush will have to change the Constitution to make this retroactive.

Of course, the Constitution is just a G*d damned piece of paper to Bush. Bush would wipe his butt with it, given the chance, he despises it so.

17. Just imagine the far reaching consequences
of declaring Ipso Facto null and void? That would mean that if they struck down Roe, every single doctor who has performed an abortion in the past 30 years could be prosecuted. They could pass a law now saying that any woman having one could be prosecuted. Again, with Ipso Facto, they could prosecute millions of people going back in time.

This concept is fundamental to ALL our laws. It is the basis of all Common Law. Damn. Talk about a Treasonous Act.
