Man paralyzed in crime receives 8-year sentence

A man was sentenced to eight years in prison Wednesday for his involvement in a home-invasion robbery in northwest Bakersfield.

Jose Guadalupe Covarrubias was one of three men who raided Norman and Romona Laxson's home Jan. 23.

He pleaded no contest to charges in mid-July, said Kyle Humphrey, his defense attorney.

Covarrubias was shot during the robbery and is paralyzed from the chest down, Humphrey said.

The Laxsons were watching television Jan. 23 when their doorbell rang.

Romona Laxson, 69, answered the door, and a man stepped inside and ordered her to the ground, according to court documents.

She yelled for her husband, who grabbed a gun and fired at two men near his wife.

There were 3 people involved, one was killed, he was paralyzed, and the other one damn lucky.

And I have no problem with the sentence. Home invasion is a horrible crime. And I wouldn't be surprised if he is faking the paralysis in the hope of a lighter sentence.

Seriously. A prisoner in Ga. who uses a wheelchair sued the state under the Americans with Disabilities Act.

Goodman v. Georgia was brought by a prisoner with paraplegia who had alleged that he was confined for 23 to 24 hours per day in a 12-by-3 foot cell in which he could not turn his wheelchair around. Mr. Goodman alleged that he was unable to use the toilet and shower at Georgia State Prison without assistance, due to the state’s failure to provide accessible facilities. He was often denied assistance, and as a result he injured himself multiple times attempting to transfer from his wheelchair to the shower or toilet; on other occasions he was forced to sit in his own feces and urine. He also claimed that he was denied medical treatment and access to virtually all prison programs and services because of his disability."
