If someone is going to commit an act of defamation a prior restraint is not available to stop it.

This little fantasy movie by ABC is a load of crap, but how can Clinton, one of the most famous men in the world, going to sue for defamation or slander? When you are famous, suing for slander is next to impossible. The more famous you are, the harder it gets.

.. the fact that this was created by a bunch of known partisans should be enough.

I'm tired of hearing this bullshit about "impossible to win". Put it in front of a jury. Make them defend their decisions in front of the world. Winning is secondary.

The Clenis should file any sort of lawsuit... I'm sure there are other things besides defamation and slander...

and get that before a judge right the hell now and ask for a temporary injunction until the matter can be decided by a jury.

They've been told about the slander and they are running it anyway. It's much harder to prove AFTER THE FACT, but this is before the fact. The fact that they refused to let Clinton et al review it beforehand, while passing copies out to wingnuts like breath mints, shows MALICE and complete disregard for the truth. Malicious behavior. Carole Burnette won a big case of libel in an after-the-fact case; with advance warning, this is an easy case to win.

when they have been placed on notice that what they are about to publish is a LIE.

That's the standard. That's why Clinton's lawyers told ABC in writing ahead of time that certain things were fabricated. See New York Times v Sullivan where the element of "actual malice" (for public figures) means that the person knew the statement to be false when it was made.

This is far more than defamation of Clinton, Albright, et al personally. The nation pays a high price for the lies that we allow to stand, unchallenged. (A war of words, not backed by concrete action, in not a challenge -- Joe Wilson has it right. You must take their lies into court.)

We in the center are great at complaining, but rarely actually DO SOMETHING.

Well, I for one am sick of it. I hope he doesn't stop with written demand to keep it off the air. The lies are out there. The damage is done. Keeping it from airing is not enough. The truth is the only antidote, and unless they put out the truth, they need to be sued.

If John Kerry had immediately filed suit against the swift boat lies, they would have gone down in flames. He would have shown strength by taking a REAL stand, and his heroism all those years ago would have been brought into the spotlight.

As a public figure he can still sue for defamation if he can prove "actual malice". Since the innacuracies in the movie have been pointed out to ABC and clearly run contrary to all the evidence it could well be that a jury would say that ABC is guilty of intentional or reckless disregard for the truth and is liable for damages.

But a prior restraint (injunction) is not a remedy that can be granted.

I was wondering if he had any recourse, since slander would be difficult to prove because of Clinton's public figure status. I wonder if they could possibly get a court order, or injunction, or something, that would stop ABC from airing this on Sunday?
