BREAKING: Bush White House subpoenaed by wiretap lawyers

RAW STORY
Published: Tuesday August 29, 2006


Two attorneys representing claimants in a lawsuit over wiretapping by the National Security Agency will subpoena the White House today, RAW STORY has learned.

Bruce Afran and Carl Mayer, who represent hundreds of plaintiffs in lawsuits against Verizon, AT&T, and the US Government, will announce today that they are serving both the Bush administration and Verizon with subpoenas.

Mayer explained that the subpoena seeks to learn "whether the Bush administration has unlawfully targeted journalists, peace activists, libertarians, members of congress or generated an 'enemies list.'"

35. The only remedy
for getting one of the Supreme Court justices removed is by impeachment. At least we have that as a possibility, although it would be almost impossible to get it done.

I grew up in the 40s and 50s, and remember when a lot of bumper stickers said "Impeach Earl Warren". If any of them deserve impeachment, Scalia, Thomas, Alito and some of the others need to go. Actually, most of them need to go.

I believe that he will. This is setting up to be a major show down regarding the rule of law in this country. I just can't see the Dictatorship submitting to the dangers inherent in a subpoena. Will the Dictator's power extend to third parties? Will the Dictator say that Verizon doesn't have to answer to the subpoena be cause the Dictator says so?

If Bush agrees to allow his administration to be subpoenaed, it could rip the lid off of the whole shooting match (to mix my metaphors).

But if Bush refuses to submit, then we will have a Constitutional crisis of epic proportions.

Look for them to play that card again as they did before the 9/11 commission, claiming that they'll testify only if they do not have to be placed under oath. Then they can say they didn't lie "under oath" and escape the perjury charge (the precedent that perjury is an "impeachable offense" has already been set by Clinton's impeachment)

One of the things i noticed from the recent terror busts (which we had a minor role in), is that all the help and resources the FBI used actually went through the FISA courts and didn't illegally wiretap anyone.

As a disclaimer, i have always had a hard time swallowing even the FISA courts since way before 9/11. So my credibility may be reduced since i don't support them necessarily on principle either. However, they are law, and some notion of privacy or defense is still included in the FISA stuff - there's at least one level of check adn balance from what i can understand.

However, the fact that the FBI still chose to use their LEGAL means to help ferret out elements of the terror plot shows that the war on terror can and should be done without sacrificing Real American Values, such as privacy and the governments non-existant rights to snoop in anyone's business -no matter how scary that may be. This is one of the cornerstone philosophies that the constitution, and the bill of rights- the entire union, were founded on.

I digress. I am much more of a lurker on here. And i'm not as vehement about a lot of the issues on this board. However, this really sets me off. I'm glad this lawsuit is happening, as when i look at terror investigations assisted in a fully legal manner - it really makes me wonder:
"if the FISA courts show their effectiveness and validity in the war on terror, then WHO are the illegal wiretaps aimed at? Especially in an administration that believes -and are starting to equate- dissent with being aligned with Al Queda? Seems to me enemies of the Admin is a broader term than most people think."

Also, with all of our country's illegal and constitution demolishing practices, why are the brits more effective at finding plots?

82. The only reason to circumvent the FISA court
is to spy on someone without terrorist connections or any probable cause they have any. FISA, if anything, was a means to expedite spying while still meeting some basic requirement to stay within the 4th amendment.

...but if you like this, thank the Green Party for it. Meyer is one of Ralph Nader's original "raiders" and a close, personal friend; Afran is past GP candidate for US Senate, and has done major pro-bono work for Greens (and others). And while you're scratching your heads over this one, you may want to ask yourself why the DP (or its lawyers) didn't file this suit.
