Broad ruling clears way for spy trial
WASHINGTON, Aug. 11 (UPI) -- An Alexandria, Va., federal judge, in a ruling with potentially broad implications, has cleared the way for the trial of two pro-Israel lobbyists.

U.S. District Judge T.S. Ellis III said the U.S. government could use espionage laws to prosecute a private citizen who gained access to national defense data.

The Los Angeles Times said the decision may be the first that says citizens other than government employees can be charged for receiving and disclosing such information. Some saw a possible problem for advocates, reporters and other information gatherers.

The ruling specifically opens the way for Steven J. Rosen and Keith Weissman, former officials of the American Israel Public Affairs Committee,to stand trial.

They were indicted last year on charges of conspiring to obtain information about Iran and other Middle East nations from Pentagon analyst Lawrence A. Franklin. Franklin, who pleaded guilty to passing government secrets, was sentenced to more than 12 years in prison.

The government's case against Rosen and Weissman hinges on applying the Espionage Act which states:

"whoever, lawfully or unlawfully having possession of, access to, control over, or being entrusted with any document, writing, code book, signal book, sketch, photograph, photographic negative, blue print, plan, map, model, instrument, appliance, or note relating to the national defense, willfully communicates or transmits or attempts to communicate or transmit the same to any person not entitled to receive it, or willfully retains the same and fails to deliver it on demand to the officer or employee of the United States entitled to receive it. . . . shall be punished by a fine of not more than $10,000, or by imprisonment for not more than two years, or both."

3. The law is already set in stone
The crooks don't get to change it. The only thing they can do is to try and repeal it before these two gentlemen go to trial. And we all know how good Congress is at getting things done in a quick and timely manner!!!

FBI counterintelligence investigators have in recent weeks questioned current and former U.S. officials about whether a small group of Iran specialists at the Pentagon and in Vice President Cheney's office may have been involved in passing classified information to an Iraqi politician or a U.S. lobbying group allied with Israel, according to sources familiar with or involved in the case.

In their interviews, the FBI agents have also named two Israeli diplomats stationed in Washington and asked whether they would be willing recipients of sensitive intelligence, the sources added.


The investigators have asked questions about personnel in the office of Pentagon Undersecretary for Policy Douglas J. Feith as well as members of the influential Defense Policy Board, an advisory panel for Defense Secretary Donald H. Rumsfeld, according to former U.S. officials who have been questioned and others familiar with the case.

Investigators have specifically asked about a group of neoconservatives involved in defense issues, including Feith, Deputy Defense Secretary Paul D. Wolfowitz, Iraq and Iran specialist Harold Rhode and others at the Pentagon. FBI agents also have asked current and former officials about Richard Perle of the defense board and David Wurmser, an Iran specialist and principal deputy assistant for national security affairs in Cheney's office, according to sources familiar with or involved in the case.

It looks like, judge just bit off more then he can chew. I heard on the radio, defense lawyer is going to drag out everything, including one that Condi leaked. This is going to be very interesting! I have a feeling, prosecuting officer will drop this case in the middle of it, when shit hit the fan.
