Mr. Scalia is the SC Justice to whom DeLay must appeal. Interesting.
August 3 - Harvey Kronberg (subscription only and I have one) is saying that the Texas GOP will appeal straight to the Supremes. The Supreme assigned to hear emergency petitions from the 5th Circuit is Antonin Scalia.
This is a Hail Mary pass by the Texas GOP and most folks think it's doomed attempt to whine and crime their way into somebody's heart.
I am so sick of the GOPper's simpering argument that Democrats are trying to steal this election. Today's decision made it very clear that the Texas GOP are the ones trying to steal the election away from the primary voters.
Texas Democratic Chairman Boyd Richie summed it up pretty well when he said today,

"I think it’s pretty obvious Republicans believed they have a liability in DeLay," Richie said. "Why would they be doing this if they thought he was a viable (candidate)?"

3. He wants off the ballot so local reep comitee can APPOINT a candidate...

which TX law only allows if the primary winner dies, is incapacitated, or some other serious event. Not "just cuz".

4. I hope this doesn't mean Scalia makes the final decision.
If he decided in favor of the repugs, that would be a bit too transparent, but what could we do?
