ROFL!!! Tom DeLay must stay on November ballot!!!

Well I think that does it folks. The winds are with us:
"The 5th U.S. Circuit Court of Appeals today ruled that former U.S. Rep. Tom DeLay must stay on the November ballot for the office he resigned from in June, according to a lawyer for the Texas Democratic Party.

Details of the ruling were not immediately available.

Democrats sued Texas Republican Chairman Tina Benkiser had violated state law and the U.S. Constitution in declaring DeLay ineligible for office so the party could replace him on the ballot.

U.S. District Judge Sam Sparks of Austin agreed with the Democrats' position last month and issued an injunction against Benkiser."

3. He wanted off the ballot for a REASON!!
He was doing bad in the polls and decided to bow out AFTER the primary had been held.

10. And I firmly believe
that he wanted to stay through the primary so he could raise the funds for his defense under false pretenses, telling people it was to mount his campaign. He is lower than slug slime ... without the glitter.

Nothing really changed from when he put himself in for the race to when he left it -- he just wanted to spend the money he raised to run for his own defense.

.. on the day of election, after his previous attempt to prove he was not a resident.

That was the basis of the lawsuit. All that matters is where he will be a resident ON ELECTION DAY. No one knows now if he will or won't be, which is why he had to remain on the ballot. I bet he votes in his Texas District if it is not to late for him to re-register there.

I suppose if he is elected, but votes in Virginia so it is provable he is not a resident of his district, that the Governor will name a replacement for him.

He moved to Virginia and claimed residency there. He's no longer eligible to serve in Texas.

Love this: "When Benkiser reviewed the public records sent by DeLay and concluded that his residency in Virginia made him ineligible, she unconstitutionally created a pre-election inhabitancy requirement," said the opinion written by Judge Pete Benavides for himself and Judges James L. Dennis and Edith Clement.

Benavides and Dennis were appointed to the court by former President Bill Clinton. Clement was appointed by President Bush, and he has considered the conservative jurist for an appointment to the U.S. Supreme Court.

"Five judges have now looked at this, two of them appointed by conservative presidents," said Democratic lawyer Chad Dunn. "It's time to move on, and Mr. DeLay needs to decide whether he wants to be in the race."

28. I don't see how that could happen
It depends on Texas law, but I'd guess that the seat would be declared vacant (having been won by someone ineligible to serve) and would then be filled in a special election a few months down the road.

DeLay can prevent that just by announcing that he's moving back to Texas. The whole point of the courts' decisions against him was that ineligibility now doesn't automatically equate to ineligibility on election day.

Our best hope is that DeLay's blatant maneuvering has alienated enough people to cost him the election.
