Airman Guilty on Four Charges

HURLBURT FIELD, Fla. -- An Airman assigned to Detachment 3, 342nd Training Squadron pleaded guilty and was convicted July 17 of four different charges under the Uniformed Code of Military Justice.

Airman Basic Brian Hart was charged for wrongful use of cocaine, underage drinking and operating a vehicle while in intoxicated. He was also charged with Article 83, which is the specification of fraudulent enlistment, for concealing the fact that he had illegally used a controlled substance before enlisting.

The trial ended with Airman Hart being sentenced by Lt. Col. Dixie Morrow, eastern circuit judge, to forfeiture of $884 a month for four months and four months confinement.

1. You sign a statement on the enlistement contract
That stipulates that you haven't used drugs. It's basically lying on the enlistment contract that makes it fraudulent.

The UCMJ gets you every time

2. Call me silly, but doesn't everyone take a physical?
You know, stuff like blood and urine tests? Are they no longer checking for substance abuse before enlisting?

3. And a puff on a ciggie at 15 would put any enlistee in the wrong.
I'm sure that's carefully put in as a way to easily kick out whoever later.

4. back in the day of drafts, what are considered undesirables today
were a majority of the new recruits, it was an option in our courts, go to jail or go to the army, etc. not sure about it being the majority as such but many recruits were given the option.
