5. The military has to abide by the UCMJ
They don't get to parse through legislation to determine whether or not a declaration of war was proper.

Besides which the IWR is the same type of military resolution that we have been running wars on for the past 65 years.

6. Actually...
It has been widely debated (on both sides) whether the War Powers Resolution (Act) is constitutional. So we could challenge it to stop the war. I remember watching this:

If the president, as commander in chief, decides to declare war, can Congress restrain him? Debating the issue are Gerald Ford, former CIA deputy director Bobby Inman, former secretary of state Edmund Muskie, and others."

You'll find people who were Democrats, whom worried about handing the ability to declare war over to the President. It is a very interesting program. Highly recommended.
