"Bush Authorized Domestic Spying Before 9/11" at Truthout says "The NSA's vast data-mining activities began shortly after Bush was sworn in as president and the document contradicts his assertion that the 9/11 attacks prompted him to take the unprecedented step of signing a secret executive order authorizing the NSA to monitor a select number of American citizens thought to have ties to terrorist groups."

Presidential executive orders are law and people are prosecuted for violations, e.g. John Walker Lindh was indicted for violating "National Emergency and Executive Order 13129"

Executive Orders Issued by President George W. Bush apparently does not include an "executive order authorizing the NSA to monitor a select number of American citizens thought to have ties to terrorist groups."

Since executive orders are laws even though congress did not pass them, can Bush sign "secret executive orders" and then use DOJ and federal courts to enforce his secret decrees?
