Iraq Veteran Sues Moore Over 9/11 Film

BOSTON - A veteran who lost both arms in the war in Iraq is suing filmmaker Michael Moore for $85 million, alleging that Moore used snippets of a television interview without his permission to falsely portray him as anti-war in "Fahrenheit 9/11."

Sgt. Peter Damon, a National Guardsman from Middleborough, is asking for damages because of "loss of reputation, emotional distress, embarrassment, and personal humiliation," according to the lawsuit filed in Suffolk Superior Court last week.

Damon, 33, claims that Moore never asked for his consent to use a clip from an interview Damon did with NBC's "Nightly News."

He lost his arms when a tire on a Black Hawk helicopter exploded while he and another reservist were servicing the aircraft on the ground. Another reservist was killed in the explosion.

hear what Michael has to say about this. I don't know about commenting on pending cases but I know Michael supports our troops and probably feels bad for this soldier.

2. If NBC had the rights to that footage would they have the right to let him
use the footage? I know he used this man's face and all, but if NBC owns that footage, is he required to go anywhere else?

I'm sure NBC made him sign a waiver saying his time and words are now the property of NBC, and they can use or sell them as they see fit.

If Moore used the interview improperly, it would be NBC who would have the beef (and the legal rights to back it up), and they certainly would have sicked the lawyers on him the moment the film was released.

3. I'm no lawyer, but
seems to me that Moore would have gotten permission form NBC to use clip rather than Damon. Damon became public domain when he gave the interview to NBC. If Moore portrayed him in the wrong light, maybe Damon has a case for that, but lack of permission? I don't think so.

One veteran, who is portrayed in Stolen Honor as a fraud who "never set foot" in Vietnam, has filed a libel lawsuit against the film's producer, Carlton Sherwood. The Associated Press notes that the veteran, Kenneth J. Campbell, now a professor at the University of Delaware, "attached copies of his military records to the lawsuit, showing that he received a Purple Heart and eight other medals, ribbons and decorations for his service in Vietnam."


Of course, it's not like we expect anything BUT a double standard from freepers.

Edit to add: of course I don't know how similar the cases actually are. I don't know if the guy suing Moore has as much of a case as Campbell does.

17. this guy was featured in two anti -Moore movies that I happened
to download (shhhhh)online from torrent sites and watched just for shits,: "Michael Moore Hates America" and "FahrenHYPE 9-11" (perhaps not both but I am sure at least one of the two. he seemed quite bitter. I am sure he has been egged on by somebody to do this. he seemed quite bitter about this

Overhype.com tried to corner the market on Fahrenhype 9/11 at the beginning and looks like they've been waylaid with too much overstock of this title. They've been trying to dump this deal for months for a buck and advertising it heavily on places like dvdpricesearch.com.

Seriously. I have been working with residents in other neighborhoods helping to rebuild, examining homes, assessing damage, geocoding and making maps, analysing building permits and city plans, talking to neighbors, etc. In fact, with that kind of money, we could rebuild a VERY LARGE neighborhood, including fixing the streets, drainage and sewage!

I feel sorry for the traumatized soldier, but he should be asking George W. Bush *directly* for some compensation.

A) I'm 100% sure MM got the rights to use the clip. If anyone thinks he didn't triple-check every single thing that went into that movie, they're crazy.

B) I'm with the others on this--this guy was put up to it. Why in the world would you wait so damn long to sue, if you were really so damaged by the film? It came out TWO years ago, for crying out loud. Smells foul.

46. MM is arguably THEE most hated progressive leftist by the right wing...
...in recent times, even overtaking Bill and Hillary. Many of the right wingers have never seen F-911, yet they claim it is full of lies. That's nuts. It was well done and accurate. MM recently visited my town and some right wing people I work with ran into him, and even on a personal level, they absolutely despise him. I admire him tremendously, but thought Bowling for Columbine was boring as shit. F-911 was excellent, but I couldn't sit through it twice. The in depth look he did at the woman who lost her son in Iraq was too damn depressing. But I saw the movie at the Michigan theater in Ann Arbor with lots of progressive thinkers and it was fabulous. There was lots of laughter and clapping during many parts of the film. It seems like the right wingers don't want to have fun. And because of that they don't want you to have any fun either. Misery loves compay, ya know. They need to lighten up and break out of the mold every once in awhile.
