49. I think their use of the term "justifiable" is interesting.

Not only does it implicitly acknowledge that such activity has not yet been 'justified,' it clearly queries one's opinion of the result of some future court hearing to test that very proposition - since only a judge can legitimately answer such a question.

Since when do we turn a blind eye when such acts do not get 'justified' at the outset?
