Hayden nominination - 3 possible outcomes
Regarding Hayden nominination for CIA Director position.... There is opposition (for various reasons) to Hayden's nomination from both sides of the aisle.

At the hearings, Hayden will be under oath and the issue of illegal wiretapping will come up and this will stoke the fires.

Bush's polling numbers are still falling and his coat tails are tripping up Republican candidates, an "up the glass - down the hatch" kool-aid drinking vote won't help republicans in November.

3 possible outcomes:

1. Public pressure will force Bush to withdraw Hayden's nomination. (least likely)

2. The Republican Congress will drink the kool-aid and rubberstamp Hayden's nomination. This is a bit tricky - poll numbers show an increasing dissatisfaction with Republicans. A Republican voting in favor for Hayden would have to weigh it against voter's concern about illegal wiretapping, and how much an "Aye" vote for Hayden would hurt/help them.

I think there would be a confirmation vote - if there are enough votes to confirm Hayden and still leave wiggle room for Republicans (who would be hurt by a YES vote) to vote NO.

3. MOST LIKELY: Confirmation vote will be delayed, and while Congress is in recess for the summer campaigns - Bush will appoint Hayden. This is the most likely outcome and will raise some outcry about bush playing BOY-KING AGAIN - however it will be bush taking the heat NOT REPUBLICANS RUNNING FOR RE-(s)ELECTION. Republicans can express "concern" with "run-away presidential powes", and make a bunch of promises to address this IF re-(s)elected

2. that's the way I see it
it leaves enough room for republicans to express 'outrage' either way

they can be "outraged" and blame the Dems for "blocking the vote" and hamstringing "our ability to fight terrorism" or they can be "outraged" over bush going behind their back with a recess appointment. Which road a particular republican candidate takes will be determined by whatever plays better in their district.

I think the dems should push for an UP or DOWN vote and get the republicans on record before campaign silly season starts. If hayden's nomination passes, the dems can use it as an example of infringement of civil liberties (i.e. wire tapping) and that republicans are rubber-cans (rubberstampers)

If it's defeated - dems can use it as an example of how they are standing up for our rights, and point out how many republicans tried to rubber-stamp it through

5. Is there NOT any restraints that The Congress can put on
"recess appointments?" I know that both parties have probably abused it's intended purpose, but come on! Bolton and NOW Hayden. That's just too much! :(

3. I am not sure
At the hearings, Hayden will be under oath

IMHO I am not sure this will be the case. The repugs hate to have their people under oath

4. are we becoming a military state?

to me this is scary, whether hayden is qualified should not be the question;but the fact that the military will be in charge of all our intelligence scares the hell out of me.
the military has a place and a purpose. but in a democracy it doesn't run the country.
i'm sure that we have many people capable of running the "cia" and the "fbi" who are civilian! and one of these should be appointed.
now if they can't communicate with one another thats up to administration in charge to
"kick butt". and i'm not sure but the military blew pre "911" intel. as much if not more than anyone.
and the next step? attack iran for political ratings? when will it end?

6. If they don't put Hayden under oath
I would support (100%) all the Democratic Senators walking out of the proceedings.

We are in dire straights - therefore, we MUST help our Republican colleagues make, at least, the morally correct decisions.

7. I'm not so sure Hayden will be under oath,
i wouldn't be surprised if the chairman of the committee waved the swearing in, they've been doing that allot lately.

8. 2 or 3 is possible
Since real elections and media are a thing of the past here in Murka, the rubber stamp leading to the public anger is not all that much to worry about. Remember...when push comes to shove it is always the POLLS that are wrong, not the VOTING MACHINES (so sayeth the MEDIA and the RIGHT WING) So I am not ruling out #2.

But #3 is also a nice way to get things done, very convenient and tidy indeed. A nice way for the pukes at loggerheads with Shrub to comprimise and play nice without seeming like a rubber stamp. Just ignore the problem and let Der Phooey handle it. But this option does not leave the door open for unjustified attacks on democrats and the "far left."
