Judge gives Martinez 2 weeks to seek hearing

FORT BRAGG, N.C. — A military judge has ruled that a New York National Guard soldier accused of killing two of his officers in Iraq has two weeks to seek a pretrial hearing to determine whether he’s mentally retarded.

Army Staff Sgt. Alberto Martinez of Troy, N.Y., is charged with killing Capt. Phillip Esposito and 1st Lt. Louis Allen in summer 2005 at a base outside Tikrit, Iraq.

If convicted, he faces the death penalty unless the judge, Col. Stephen Henley, finds that Martinez is mentally retarded.

Henley said Thursday that the defense has until Jan. 24 to seek the pretrial hearing on possible mental retardation.

The next hearing is scheduled for March 20, and his trial is tentatively scheduled for June.
