TORONTO — A U.S. Army war resister living in Toronto who was scheduled to be deported Tuesday has been granted a temporary stay of removal by Federal Court.

Kim Rivera served in Iraq with the American military in 2006 but moved to Canada the following year after she refused redeployment.

She has been living in Ontario with her husband and three children, including a six-week-old girl who was born in Canada.

Ken Marciniec of the War Resisters Support Campaign says Federal Court told Rivera’s lawyer last Friday that she would be granted a temporary stay of removal while the court decides whether to hear her case.

Marciniec says he doesn’t know how long it will take for the court to decide on Rivera’s fate, but for now the stay of removal is good news for her and her family.
