Judge OKs photos of bodies at Martinez trial

FORT BRAGG, N.C. — A military judge says photographs of the bodies of two Army officers can be used as evidence during the Fort Bragg trial of a soldier accused of killing both men by detonating a bomb in Iraq.

The Fayetteville Observer reports the judge made the ruling Wednesday in the case against 41-year-old New York Army National Guard Staff Sgt. Alberto B. Martinez.

Martinez is charged with premeditated murder in the 2005 deaths of Capt. Phillip T. Esposito, 30, of Suffern, N.Y., and 1st Lt. Louis E. Allen, 34, of Milford, Pa. Both were members of the 42nd Infantry Division.

The judge also ruled the officers’ widows could attend the trial, scheduled to begin Oct. 6, and a live broadcast could be made available at West Point.

If convicted, Martinez could face a death sentence.
