Kansas City, MO. August 25, 2008. Bradley J. Schlozman, former US Attorney for the District of Western Missouri has been named a defendant in a RICO lawsuit for interfering with ongoing federal civil litigation over the Novation LLC hospital supply monopoly created by Curt Nonomaque of the Texas based VHA, Inc. and Jeffery Immelt CEO of General Electric Company (GE). The ongoing lawsuit filed in June of 2003 by Samuel K. Lipari of Lee’s Summit, Missouri is currently captioned Lipari v. General Electric Company, et al, W.D. of Missouri Case No. 07-0849-CV-W-FJG and is being presided over by the Hon. Fernando J. Gaitan, Jr., Chief Judge of the US District Court for the Western District of Missouri.
Bradley J. Schlozman was added as a RICO (Racketeer Influenced and Corrupt Organizations Act, 18 U.S.C. § 1961–1968) defendant on December 7, 2007 for fraudulently testifying before the US Senate Judiciary Committee in what Lipari’s complaint alleges was part of an effort to conceal interference with the ongoing civil antitrust litigation over Novation LLC’s monopolization of the hospital supply market to defraud Medicare, which included obstructing justice in the criminal prosecution of Cox Health Care Services Of The Ozarks, Inc. (“CoxHealth”) in Springfield, MO and its CEO Robert H. Bezanson. The Medicare prosecution of CoxHealth was initiated by Schlozman’s predecessor Todd P. Graves. The lawsuit documents why Todd P. Graves was unlawfully removed as US Attorney for the Western District of Missouri for initiating the prosecution of CoxHealth and Robert Bezanson and was later discovered to be the “Ninth US Attorney” illegally fired.
The Hon. Fernando J. Gaitan, Jr., is now deciding the effect of a June 9, 2008 unanimous ruling by the US Supreme Court determining courts cannot dismiss RICO complaints over a judge’s challenge to the nature of injury suffered by a prospective RICO plaintiff.
