Ohio Anti-Gay Amendment Does Not Void Lesbian Mom's Rights Court Rules

Ohio's constitutional ban on same-sex marriage cannot be used by a woman to prevent her ex partner from visitation rights to a child they were raising a Columbus judge has ruled.

In addition to banning same-sex marriage the amendment, known as Issue 1, says the state "and its political subdivisions shall not create or recognize a legal status for relationships of unmarried individuals that intends to approximate the design, qualities, significance or effect of marriage."

Lawyers for Denise Fairchild argued in Franklin County's domestic relations court that the amendment extends to adoption.

Fairchild had a boy by artificial insemination when she and Therese Leach were a couple and the two women cared for the child.

2. Same year that
10 (?) other states did, have to bring out the right wing vote. 2004.

3. despicable...
what Ohio voted for... I've become certain that people are so vehement in wanting to prove they're macho & straight and not "a gay" that they vote in this shit. they're scared of their own sexuality and want to make it clear to their own psyche what they are. these kind of laws shouldn't be something for debate, it should be in the constitution that we all have equal rights --- oh wait, we have that already don't we?
