4 arrested in N. California gang rape of lesbian

Two men and two teens have been arrested on suspicion of gang-raping a woman last month in the San Francisco Bay area while allegedly taunting her for being a lesbian, police said Thursday.

Officers arrested Humberto Hernandez Salvador at his Richmond home Wednesday night, Richmond police Lt. Mark Gagan said. The 31-year-old is being held without bail on gang rape, kidnapping and carjacking charges.

Police on Wednesday also arrested a 15-year-old Richmond boy and a 16-year-old Hercules boy, who were being held at a juvenile detention center on similar charges. Their names were not released.

Josue Gonzalez, 21, turned himself in Thursday after police announced they were searching for him. He was wanted on charges of gang rape, kidnapping and carjacking.

They're not adults and the presence of two adult males in the pack should be a mitigating factor.

Keep them in juvie until they're 21, then evaluate them very carefully. My guess is that they'll end up serving out their sentences in an adult facility, but they don't belong there right now.

21. There are two parts to juvenile justice--trials and sentencing

I think they should be considered separately. There is no need for special juvenile trials IMO. The same standard that declares some adults incapable of standing trial would apply to most young kids. So, single standard. However, the part about serving sentences should be definitely different for juveniles--no mixing them in with adult offenders, age-appropriate rehab, etc.

to rehabilitate them, then you are absolutely right. They'll stay as vicious and violent as they are now, with all the bad influences they've picked up, and even more that the system will beat into them.

But they're teens. It might be possible to get to them and pull them back. I'd at least try to get them into intensive counseling in Juvie.

get into kids that young, and get into them that deeply. I wish we could counter those hurtful, horrible cultural messages. Rape and sexual assaults are too common to be committed by bad apples. We're teaching and training boys to do this.

But sexism and homophobia are embedded very deeply, and our efforts to fight bigotry are only scratching the surface. :(

We have to teach boys that girls are equal people, not lesser people or sexual things or toys. But damned if I know how to do this while all the sexist and homophobic parts of our culture are fighting back.

I've been in that argument a million times. Not all immigrants are criminals and not all native-born Americans are law-abiding. There are plenty of immigrant women, legal and non- who get raped. So I kind of think that the issue of immigration status where this is concerned is a non isuue. These guys gang-raped a woman...that is what should be our focus here, not where they came from.

Anyone who does not conform to societies' narrow definition of male and femal appearance runs the risk of hate crimes.

For some it stops with verbal abuse, but in tragic cases such as this one and others we know about that end in murder, the only motive is because someone doesn't fit the perps bigotted expectation.

That second story (link) came from Canada, right after Hate8, when two women, went to pick up their child from school and a crazy man spit and punched one of the women in the eye spouting hate language. I bet someone might recall and have a permalink.

How about the two brothers, who were straight and from somewhere in S. America, they came out of a restaurant a little tips holding onto each other and mistaken for gay, one was beaten with a baseball bat so badly he died a few days later of head injuries. That story was just a few weeks ago.
