Judges have been blocked before, but the problem is no matter who Bush picks, they will most likely be a far right wacko. It's true that other recent repuke presidents have accidently put in stealth liberals or moderates, but I don't see that happening again (especially with the extreme fundie pressure Bush will get when a space is vacant).
I'm not sure how the Dems will handle it, but I'm not optimistic about keeping an anti-choicer out.
But keep in mind that right now, there are 3 firm Anti-Roe votes in the SC right now. Thomas, Rhenquist, and Scalia. Kennedy is Pro-Roer, but he's stradled the fence at one point (but I think he'll stay Pro). The other 5 are firm Pros.
Most think that Bush will get 1-3 new judges (:puke:). One goner will definitely be Rhenquist, so that's an Anti out and probably another Anti in.
Score is still 6-3.
There's a good chance O'Conner will leave. Fundies will go wild if it happens, and I'll bet alot of people's heads will explode here at DU.
5-4.
I'll stop there. Let's pray we don't reach 3. :)
I don't know what will happen to Republicans if Roe is kicked. Most polls say the public supports Roe (2 to 1 margin), but are people passionate enough about the issue to punish them for tossing it? I know for sure that the "Right to Life" people aren't going away. They still have to pressure individual states if they want abortion gone for good. And they will probably keep voting for Republican presidents in order to keep pro-choice judges out.
