Ex Cowboy Michael Irvin accused of rape..
Michael Irvin has been accused of rape in a civil suit filed Thursday in Broward Circuit Court, the Miami Herald reported.

The suit, filed by a woman identified as "Jane Doe," accused Irvin, the former Dallas Cowboys wide receiver and Pro Football Hall of Fame member, of raping her at the Seminole Hard Rock Hotel & Casino in Hollywood, Fla., in 2007, according to the report.

No criminal charges have been filed. The Broward State Attorney's Office has been investigating the case and a spokesman told the Herald he expects a conclusion next week.

Irvin, currently in South Florida for the Super Bowl, currently hosts a talk show on ESPN Radio 103.3 in Dallas and works as a television analyst for the NFL Network.

Irvin's lawyer, Larry Friedman, called the accusations "totally untrue," according to the Herald. Feldman, asked by the paper to describe the woman's contact with Irvin, said: "Beyond, perhaps, meeting her, there was nothing."

According to the suit, the woman claims the attack happened late on July 4 or early on July 5, 2007. It claims a Irvin bought the woman alcohol and took her to his hotel room, where Irvin raped her and another man forced her to perform oral sex. The other man is unidentified because, according to the woman's lawyer, David Lister, she doesn't know who he is.

The suit claims Irvin's brother, Derrick Irvin, "assisted in covering the sexual assault and rape up," according to the lawsuit

Keep in mind, much like Kobe Bryant, Irvin no doubt has the money to settle this and we'll probably never know the truth.

1. Then why did the victim sign a waiver of prosecution?
Doesn't make sense.

2. Apparently there was no evidence by the time this came to light.
It is really a he-said she-said issue now.

3. Exactly. But by signing a waiver of prosecution
she essentially let Irvin off the hook. Then she comes back with a civil suit years later -- after settlement talks break down.

Is she after punishment or money?

6. Good for her I wouldn't be a juror...
sounds like additional golddigging to me. I'm not defending Irvin -- but she had better chances to get him earlier, IMO

7. It could be a case of wanting money
we've seen enough of that involving women extorting money from pro athletes. Then again, we've had a lot of athletes acting like pigs and thinking they're above the law..

And remember, Irvin graduated from two of the top places for burgeoning criminals in the country...University of Miami and the Dallas Cowboys.

5. About Kobe Bryant...
Kobe Bryant was IMMEDIATELY cooperative with investigators and give them full details of what happened and even submitted to a voluntary lie detector test. Also witnesses said she was bragging about the sexual encounter at a party and seemed happy and having fun. She also gave a meaningless lie such as arriving late at the hotel because of car trouble and then said Bryant made her wash her face 3 times, then said she never washed her face. She also said something to the nurse that she didn't say to detectives about what happened. The hotel's night auditor said she didn’t look upset when she came back from Bryant's room, and didn’t believe she was telling the truth. The prosecutor dropped the charges because she was unwilling to testify.

There is plenty of information out there, the smoking gun has a great collection of it. The thing is she lied about minor details such as car troubles and other things. People will continue to feel he is guilty but there is plenty of doubt in that case.

8. UPDATE: Irvin files countersuit of $100,000
ESPN.com news services / 02-05-2010

Michael Irvin, accused of rape in a civil suit filed Thursday in Broward Circuit Court, has filed a $100 million countersuit.

The suit, filed in Dallas County, Texas, asks for $100 million due to the allegations filed in a lawsuit that claim Irvin, the former Dallas Cowboys wide receiver and Pro Football Hall of Fame member, raped a woman identified as "Jane Doe" at the Seminole Hard Rock Hotel & Casino in Hollywood, Fla., in 2007.

<snip>

Irvin, currently in South Florida for the Super Bowl, had hosted a talk show on ESPN Radio 103.3 in Dallas and works as a television analyst for the NFL Network. He no longer works for ESPN Radio 103.3, but a spokesman said Friday he will be on the air this weekend for the NFL Network.

<snip>

Irvin's lawsuit claims that the civil suit filed by the woman caused him to be fired from his radio job. "This is nothing more than a thinly veiled effort to carry out Plaintiff's extortion plot while capitalizing on the media circus that is Super Bowl weekend," Irvin's lawsuit said.

13. Wrong again, as usual
Do you even read my posts? Ever since Manny* tested positive I've been no fan of his. Or did you miss all the times I said I wish he would leave so Pierre could get more playing time? You're such a hypocritical douche. I'm honest about my teams and players. When they fuck up I let 'em have it. You have never been honest since day one of your birth, which probably occured about 12 years ago. While I'm putting up threads about Steven Jackson beating up a pregnant woman you're busy sucking Baroid's cock and shrivelled balls.

Wotta douche.

14. I see..
do you root against Manny* when he comes to the plate? Not that I would expect you to, just don't give me that BS about how you let him have it....yeah, while at the same time cheering for Ramirez when he hits a HR.

Btw, Bonds has not been a member of the Giants since 2007. Your continued pattern of bringing up his name smacks of desperation...for the old roid argument goes right by the CLEAN Giants and sticks to your dirty Dodgers*..

15. Oh come on now...
That's how you came to prominence here at DU---

You're other alias Cboy was getting smacked around pretty hard on his insistence that Barry didn't use the juice... and then up popped you...writing in the same exact prose as Cboy.... and defending Barry exactly in the same manner as Cboy.

But now--- you want us all to forget about those days... in other words, look past your hypocrisy.

That Cboy/Upton is why you're the biggest troll douche in the sports forum.

17. Broward prosecutors decline to charge Irvin in rape investigation
<snip>

"Broward prosecutors said Wednesday they will not file criminal charges against Michael Irvin after a woman accused him of raping her at the Seminole Hard Rock Hotel & Casino.

The woman said the rape happened over the Fourth of July holiday in 2007.

In a memorandum, the prosecutor wrote the decision was based on a lack of medical evidence and inconsistencies between what the woman said and what others who were present told prosecutors.

However, Irvin still faces a civil suit, filed earlier this year by attorneys for the woman in Broward Circuit Court."
