"FACT: In the 2002 midterm election, there were fourteen House and Senate races across the U.S. where Democratic candidates were leading in the last pre-election polls by margins of 4 to 10 points. The votes in all those races were counted on either ES&S or Diebold optical scan or touchscreen systems. In all fourteen races the Republican candidate won by 3-7 percentage points. Republican control of the House and Senate were decided by these races. In the case of Senator Max Cleland of Georgia who was defeated by Saxy Chambliss, it took a sixteen point swing."

Good article; much we already know but I learned some new things. Well worth reading.

Dear Bart,

In my original e-mail I asked a favor to which you graciously ssented. The favor I asked was that you “allow me the opportunity to make a written argument to you that: 1. Kerry won this election and it was stolen from the American people; and 2. that computerized vote recording and counting is the single most important issue in the survival of American democracy.”

The argument is below. It has been reduced from an original draft that ran 32 pages. Before proceeding to the argument, however, there are two preliminary matters to be dealt with.

The first of these is to answer the question: Why am I making this argument to you? You are an opinion leader of growing influence on the web, and an important part of the new “alternative” media which is our last best hope of preserving this nation as a functioning democracy. You have a growing audience of readers and listeners who tend towards activism and who are, like most on the left now, groping for a handle on what to do next, and how to explain the election results. You are one of the “leaders” to whom they are looking to tell them what to do next. It is my hope that, after reading my argument, you will lead
them to focus on the right target. It is no longer about getting rid of Bush. It is about defending against an all-out assault on our right as a people to chart our own destiny and our ability to oust those leaders who fail us.

Second, I’ve learned over the years that an argument without a frame is an inherently unstable structure vulnerable to all sorts of rhetorical undermining. So I would like to preface the argument with the frame.

I am NOT attempting to PROVE my dual premise in a court of law. It will take the resources of a state attorney general or more to uncover much of the actual physical evidence which I am convinced exists. My preference would be that you read my argument from the viewpoint of a member of a Grand Jury being presented with a summary set of facts. You are being asked to decide whether or not they indicate enough of a possibility of wrong doing to warrant issuing an indictment and conducting a full and thorough official and public investigation. It seems to me that if you find my argument for the first premise convincing enough to vote for an indictment, the truth of the second premise follows automatically.

but don't know the others. Undoubtably Katherine Harris. Anyone else know? You could probably take a look at legislators who seem to be oblivious to their constituents who are from states with paperless DREs and figure it out that way.

Barnes(Ga. Gov) was one ousted by fraud apparently,

Mondale was leading by 6 points...everyone was turning out after Wellstone died...

why not ask our REPUBLICAN secretary of state Mary Kiffmeyer? Her idol is Katherine Harris, by her own admission.

We use optiscan ballots here, by the way.

...definitely some interesting stuff, but several of this chap's "facts" are actually opinions and/or circumstantial theories.

I only say this as it seems to me that if you were to present this to the non-believers as part of your fraud argument, phrases like "the Bush crime family" will hardly be persuasive.

Think of Biden at the hearing on Bolton yesterday: by sheer weight of real facts and hard evidence (corroborated testimony, patterns of provable behaviour, examples of undiplomatic behaviour) he eventually bludgeoned the enemy into submission: they couldn't hide from the overwhelming, unvarnished truth. Biden boxed clever.

If he'd started talking about "the Bush crime family", Bolton would already be on his way to New York.

21. Agree; I don't ever use inflamatory terms unless I'm talking to us. I
really like the way Chuck Herrin frames the issue; very non-partisan and I don't think we can afford to alienate potential allies by using inflamatory language.

elected thru e-voting fraud, and seems you are verifying that? Would certainly explain why he is SO responsive to his constituents, and SO concerned about the ethics charges against him, wouldn't it? That's the scariest part, is they can do whatever they please when they know they don't have to answer to constituents any longer since they can keep getting themselves re-elected no matter what.

If someone got say, a collection of 10,000 letters or so and flooded Voinovich's office.....calling for his testimony, he might blow the whistle on the Diebold election scheme that got him and Faircloth elected.

Faircloth ran against John Edwards, and was set to win except the CNP board of thugs decided against it...Faircloth lost the seat to Edwards.

They all have been in this game, where a religious leader claimed "only christians should be allowed to vote" and other strange statements that were uttered more than 3 years ago.....

G. Mustain has a great article there, but for me it is "preaching to the choir" because I have been convinced that the last three elections were fraud for a long time now. I guess I'm a little disappointed in the large majority of my fellow Americans and want to give them a sharp "kick in the butt" to wake them up. I have been working this problem very hard lately, and taking a large portion of grief because of it. My problem, not yours.

But, you force me to realize that it's people like you that make the fight worthwhile, and I appreciate the mere fact of your existence more than you can imagine. I am very, very sorry if I irritated you! If it were not for people like you I would be out of this country in a heartbeat and never look back.

I know that davis, cleland, and probably daschle were screwed by these systems, does anyone know about either of these?
Betty Castor had a tight race with Mel Martinez (Cuban American ties)
and Jeanne Shaheen lost to Sununu...and mainly I just dont' trust Sununu...

I'm not a newbie...but I retired my last ID...not much of a loss and more anonymous now

and Diebold tabulating machines are the same.

He is also pointing to the GEMS source code and hidden "fun stuff" found evaluated and released in 2003 Dec. I know Avi Rubin and the Iowa Univ. analyzed this one in 2003.

Does any one know if these in fact remained the same in 2004 Nov?

I tried to get the original information source on this.

It sounds like they kept it the same, and only changed the way passwords work.

For proof just see http://www.blackboxvoting.org hack the newest ones, in about twice the amount of time, on a real election (about 5 minutes)

Yeah not everyone trusts them but their report is correct...so the source code, once divested, will likely look the same.

54. I would especially like verification that the code is the same for Diebold
and ES & S. There is more info out there about Diebold than any of the others. It would make it easier in educating people (particurly election officials, which is what I am currently working with) to be able to say it's the same. I haven't found info on the criminal backgrounds of software designers except for Diebold but if they all use the same stuff, that would take care of it.
Anyone have any more on that?

51. Not discounting the article, but if Cleland's internals showed him up 7...
He should've sued the state for election fraud. When it's a one point race Diebold can EASILY turn it the other way. 7 points is a different animal if the candidate is actually willing to do something about it.

If the Secretary of State (who is a dem BTW) is using Diebold machines to rig the votes then the Governor should be able to find out.

I think not? who's going to compile the list?
It would be useful to have a list of the official results vs the
exit poll result and pre election polls.

In an article entitled
"American Coup: Mid-Term Election Polls vs Actuals"

they compare the results of 19 2002 races to pre-election poll results. Here is their summary:

Scoop’s analysis shows that - according to the polls - the Republican Party experienced a pronounced last minute swing in its favour of between 4 and 16 points. Remarkably this last minute swing appears to have been concentrated in its effects in critical Senate races (Georgia and Minnesota) where it secured it's complete control of Congress.

58. I don't think the swing in the Cleland race was 16 points, more like
12-13 points, but when you get to that level, what difference does it make? It's like saying there's a 95% likelihood the victim's blood matches the type discovered in your car as opposed to a 99.9% likelihood. Either way and there's no jury that would fail to convict.

I'm glad to get that number. I suspected there were a large number of Repubs voted in by fraud. The MN race was the most interesting to me. I thought at the time there's no way Coleman beats Mondale in a fair election. And I suspected several other places as well.

I think 2002 was the year democracy died in the US, courtesy Diebold, ES&S, et al.

God knows what will happen before we get it back, if we ever do.

Republicans ? even when displaying ample motive, means and opportunity (not to mention, sleazy history) ? wouldn?t try to exploit this frightfully advantageous situation, would they?<12> Perish the thought.
