Andy Stephenson has hepatitis & needs our help.
Andy was diagnosed with infectious hepatitis on Wednesday. He is extremely sick and has been ordered to six weeks bed rest. Right now, his state of mind is extremely low -- as is to be expected.

This means that he is unable to work for the next six weeks -- and with the large sum of money that BBV owes him still unpaid -- that he is in serious financial straits. The bottom line is: Andy needs our help.

37. I saw a kid bash his head open falling off a bike.
He wasn't wearing a helmet, so it didn't meet my strict criteria for helping out.

I made a few disparaging comments, though, and moved happily along with my rather 'progressive outlook'.

Actually, UN-DETERMINEDPROGRESIVE, I'm sorry that your post met your own criteria for decency.

Petition hell! If you know where she is going to be, post it. We can go there and demand she pay up. She got a nice chunk of money from her California suit, never mind what she got from folk's here.

She also has Andy's laptop (they are demanding he prove he didn't "but it" with BBV money, which is ridiculous since he brought it with him before he was on salary) and owes him salary and expenses.

Quite a bit of the information she has produced came from other sources, such as Roxanne and her team.

I have worked on issues like these before.

To pick a nit:

"Bev Harris" does not owe Andy Stephenson.

Black Box Voting, Inc. may owe Andy Stephenson if he has properly documented any expenses. Such payments may or may not be overdue, depending on when he submitted substantiating documents and the request, and whether he submitted a clean request (i.e. one which contains no unauthorized expenses) or one that mixes in nonexistent, personal, or unauthorized items, thus requiring someone in accounting to verify every line item.

If the amount requested was submitted late, or includes amounts that are not properly documented, or amounts that are not authorized, it tends to delay disbursement.

If the structure of the corporation includes a board of directors (and a 501c(3) must be structured in that manner), it would be the ultimate decision of the board whether to pay Andy Stephenson.

1. Who signs the checks?
2. Who authorizes disbursements of "several thousand dollars"?
3. When were the expenses submitted?
4. Were the expenses authorized, documented properly, and appropriate?
5. Are there other issues (i.e., for the computer, did it contain work done for hire?) It probably did. If Andy Stephenson accepted a salary, his work product belongs to the corporation, not to him.

Are there any other employees? Have they experienced similar problems? Has anyone asked Black Box Voting what's going on?

It seems highly unlikely to me that an entire board of directors would agree to refuse to pay legitimate expenses. My guess is that this is an accounting issue, an issue of when the reports were submitted, and an issue of which expenses are legitimate. I've seen these kinds of employment disputes before, and I take one-sided claims like this with a large grain of salt.

First, he loves every one of you and thanks you.

Second, the free clinic that diagnosed him called him back in to run some more tests. After that, they are sending him to a hospital for an ultrasound and more tests. We don't know what this means, and cdertainly have no idea if they will admit him or not.

When I have more news, I will post it.

Hepatitis is noting to laugh at-I've had Hep A twice and B, plus jaundice and gall bladder removal.
REST.
Keep your fluids up, and eat even though you don't want to.
Watch a lot of TV, and rent movies if you can too-keep yourself entertained and it may help with the itching. Antihistamines help a little too.

It's possible, also, to supplement western care with it.

I've received some really good treatment (and lots of satisfying my curiosity about it) using College Clinics.

Charges were @$10, and that's when it wasn't "Free Friday" or something.

You're in the Pacific Northwest? They're into it up there.

50. I am on the phone with Andy now- he thanks everyone!!!
No news until Monday--however-- it's not Hep A, B or C-- his liver enzymes are 10X normal which has the doctor very worried. Ruled out lots of other things- more tests in the hospital on Monday.

He appreciates everyone's support, prayers and love! He's feeling very down and worried so please keep sending those- they will make a difference!


(Private note from me- Andy is especially concerned about money right now since as many of us know, he is in between jobs and cannot afford huge medical expenses. He could use some financial help. Please email him for his address if you can send money and it doesn't work using the paypal system mentioned in the initial post. His email address is there too- but here it is again must in case: @ andy_stephenson@comcast.net.

Also, perhaps if everyone emails BBV and Bev to ask them to send him the money he is owed, she might consider helping out. For all of us who sent her money when she needed help- let's remind her that now is the time for her to rise to the occasion.)

79. I can't send any money right now, but let him know he's in our
prayers. If he has the chance, or someone can get it for him, he should get some milk thistle. It's an herbal remedy for the liver - they're in the process of approval for treatment of liver disease/hepatitis in Germany. When I had Hep. my doc told me to take it, and it did wonders.

Please don't flame me - just expressing a thought.

Will there be calls for donations more frequently when say, a DU'er gets laid off or has a medical bill? Not to say that such calls for help aren't worthy and right, just concerned that some might take advantage of our generosity.

52. He should look into getting a Vit C/mineral IV; when help lots
and causes no harm. It can make a huge difference. Is commonly used by those who know for such purposes.

There are also other things that help. Boost immune system.

Black Box Voting, Inc. MAY owe Andy Stephenson, depending on what was originally agreed to and what has been substantiated with appropriate documentation.

1. Is Bev Harris even a signer on the corporate checking account?
2. Does Bev Harris do payroll?
3. Is Bev Harris the accountant?
4. Does Bev Harris have the authority to tell the board of directors and the accountant to refuse to pay amounts due, if they are properly documented and authorized?

Though it is apparent from the posts in this thread that Andy Stephenson talks to many people about the specifics of what he feels he is owed, in an employment matter, gossip to friends is simply not relevant. Disbursements are paid when appropriate documentation is provided to the decisionmakers who are authorized to write the checks.

I find it unusual (and somewhat inappropriate) to see an employment matter discussed on an internet chat forum, especially if the employer is never asked for the other side of the story. Perhaps more fact-checking is in order.

Here is a point that perhaps no one here has considered: If Black Box Voting, Inc., as a 501c(3) nonprofit, pays Andy Stephenson for personal or inappropriate expenses, this is likely to be viewed by the IRS and by donors as unjust enrichment. Items like phone calls to one's mother, cigarettes, and pajamas will be questioned by the IRS if paid by a nonprofit without documentation to show how, when, and why these items were authorized in the first place.

Just my two cents,

You know what? I don't give a rat's ass about the legalitites. Bev Harris has a MORAL obligation to PAY the money SHE owes him. If she has a problem with the definition of "moral obligation", there are plenty of folks here who would be happy to explain it to her in very small words.

Now, if you will kindly provide the name of any nonprofit 501c(3) organization that pays for cigarettes, five months of personal phone calls, or underwear, or pays for expenses before getting any expense reports please list those organizations here.

Let's see, who do we believe? 69. Perhaps this will help expedite things for Andy
1. Itemize past due salary. Include substantiation documents and dates. For example: Dates the work was done, what was done, documents or agreements as to the pay scale that was agreed upon for the work.

2. Itemize any expenses and submit receipts. Show the dates when expense reports were submitted for these. Include a copy of the expense report.

3. Propose a time and place to pick up personal items (most employees clean out their desk when they leave; I'm new here, and perhaps it's been explained before why he left his computer there in the first place.

Normally when an employee is on a fixed salary, there is no additional payment for "work performed" -- therefore, I am assuming that Andy Stephenson is alleging that a pay period was missed? Identify which pay period was missed. Or, if he alleges that an additional amount over and above salary should have been paid, he would be expected to produce evidence that an additional agreement had been reached for compensation, and in that event, would need to produce evidence that the work was completed.

The documentation of requests for reimbursement on employment-related claims makes all the difference. It says on the website that Black Box Voting Inc. is a nonprofit 501c(3). Therefore it has a board of directors.

I would doubt that Bev Harris would have the authority to refuse to pay him. He should address all correspondence to the board of directors, and it should be sent certified mail, not by email and certainly not by posting it on an internet chat forum.

Key questions: Who signs the checks for the corporation? This would be the person who should be provided with documentation of the work performed/agreements/missing paychecks.

After looking over the site, it seems unlikely that Bev Harris would be the one signing and sending paychecks. The amount of travel for that job description makes it unlikely that they would have had her doing the paychecks.

I would doubt that an entire board of directors would refuse to pay someone their wages. In companies where I have worked, these issues are usually actually caused by the employee requesting funds that were never agreed to, or failing to provide proper documentation (i.e. mixing in personal expenses, which slows disbursement because the accounting department then has to verify every expense).

What date was the documentation provided by Andy Stephenson? Did he file his expense reports as soon as he returned from his trips, which is customary, or did he file them after his termination? If they were not filed until after his termination, when were they filed? My experience, and this was with a major law firm, is that if expense reports are not filed until after termination, especially if they also contain personal items, it may take a few weeks to pay them.

One further situation that can delay payment: If Andy Stephenson has also retained equipment that belongs to Black Box Voting, it may be that they have asked to have the equipment returned at the same time he picks up his things. Or, they may have asked him to sign a release when picking up the equipment, stating that he picked it up.

I would guess that this situation has more to it than meets the eye. It is extremely unlikely that another employee (i.e. Bev Harris) would have the authority to block payments due to Andy Stephenson if they were submitted timely, properly documented, and appropriate.

Just my two cents.

95. It's a kind person who will join DU and immediately jump in a thread
to "help" Andy 3 times. Very thoughtful, too. As I said in another post, I donated to BBV twice, before I learned of certain practices of Bev's which made me hesitant to donate any more money to that particular cause. However, I'm quite sure if she wanted Andy to be paid, he would be paid.

Sadly, a person who is ill and without funds is really not in a position to jump into a legal battle about money due him. I'm sure there is more than meets the eye, but I really think Bev should re-think her position on this, and treat her former employee as a human being should be treated. Once again, with all due respect, I am quite sure Ms. Harris could ensure that Andy was paid, if, in fact, she wanted to.

He called me around 8 his time this morning, saying he was fine and wasn't going to go to the hospital for tests. Unfortunately, his symptoms hadn't disappeared overnight and I talked him into going anyway.

So I assume he is now in the hands of the healthcare jungle.

107. Read the book by Naiomi Judd - she apparently beat it and is
actually a very bright person. She studied the issue after she was diagnosed (she had been a nurse in a previous life) and has been in 'remission' for a long time.

I know nothing else except that she really seemed confident and had a handle on her hepatitus. I don't know what type it was.
