To do list:
1: Each group choose a coordinator. If you are currently the only person listed in your group, then this is you for the time being.
2: Each team pick a coordinator. If you are currently the only person listed in your team, then this is you for the time being.
3. Each group coordinator should check in with me via Pm or e-mail. If you do not have enough posts yet to do this, please indicate so in the thread.
4. Each team coordinator is responsible for getting the “Statement of Vote” in electronic form from their county. If the document is readily available online, please post the link in this thread with the title “SOV – County name.”
5. Each team coordinator should e-mail me directly to get a copy of a records request we need to follow-up on the Statement of Vote data. We will be more effective if each records request gets more individual attention. Any records request issues will be followed up with by me, with the assistance of an attorney group who is aware of the issue related to these records.
6. Each group coordinator should check in with me by e-mail, and I will send you better contact info. Your responsibility will be to make sure the Statement of Vote and the records mentioned in number 5 (above) get back to me.
7. I will process the data here, and import both data sets into one easy to read document.
8. Someone who can host a series of 58 excel sheets and a menu page (with links), please let me know. If not, I will order some hosting service.

At that point we will be ready for part III. :) That’s when thing will get fun. :) :) :)

Rules for this thread:
1. Please do not post in this thread unless you have first Pm’d me to let me know you can help with the project. Please indicate which county you can help with, or any other info that could be helpful.
2. For those already on the list, please always lead your post of by placing the county name in the subject bar. If you are reporting issues related to the Statement of Vote, please have “SOV” in the subject header. If you need help processing records requests, please Pm or e-mail me, or if you haven’t enough posts to do so, please indicate so in the thread, but do not disclose records request related info here.
3. I will start a “kick” post on this thread. Please help keep this thread kick here and again by posting a reply kick directly to that post, as opposed to elsewhere in the thread, so we can keep the thread easy to read.
4. I will post new volunteers to the list as they come forward. Keep an eye for new teammates and be inclusive!
5. Don’t get burnt out. If you need a day or two from working on this project, just Pm me so I can find someone to help pick up things in the interim. :)

Btw, even if you’ve already sent me the "Statement of Vote" data personally, please try to find a link and post it here as well. Make sure to figure out who is coordinating what area.

Please call (800) 815-2666 or (562) 466-1310 for details.

What we need is the Statement of Vote. Whoever calls should just ask for the Statement of Vote in electronic form (pdf/excell/etc.) They may try to sell you a CD-ROM for close to 200. Just mention that you don't need the whole disc and you only need the Statement of Vote electronic file, which is a public record and subject to the CPRA.

If they still give you a problem, Pm me right away with the details, and I will follow-up. :) :) -G

Election records office was completely unfamiliar with the California Public Records Act, but did seem genuinely concerned that they may be charging fees in excess of law. They asked if I would be able to send over documentation, and when I do, it will be accompanied by a CPRA/Prop. 59 request giving them no more than 10 days to make a determination and get the data to us. Just so you know. :) -G

The deleted post was a copy of the CPRA request that I sent L.A. County to obtain the official "Statement of Vote" file. The County wants to charge $56 for what is obviously a public record. This is well in excess of the direct cost of copying this document. This is the first time I have seen a county do this. If anyone else notices this practice out there, please Pm me right away. :)

I still ask that all records requests for this project go through me for now, so I can help manage us through any snags. Still, all us advocates for democracy should start to get used to the look and feel of these things. :) :)

RE: Public Records Act Request

Dear Mrs. XXXXXX,

Pursuant to my rights under the California Public Records Act (Government Code Section 6250 et seq.) and the California Constitution, as amended by passage of Prop 59 on November 3, 2004, I am writing to request a copy of the following records, which I understand to be in the possession of your agency:

“Statement of the Vote” (or perhaps titled “Statement of Vote”) for the 2004 General Election, as sent to the Secretary of State, in its electronic form (i.e. pdf, excel).

I ask for a determination on this request within 10 days of your receipt of it, and an even earlier reply if you can make that determination without having to review the record(s) in question.

I would not ordinarily trouble you with this written request, but as we discussed by phone, the charge of $56 was of concern. I respectfully suggest that this position, that the County may charge such an exorbitant fee based on a Board of Supervisor’s approved schedule of fees, if I understand it correctly, is wrong. It is wrong because only direct costs may be assessed, and in the instance of the “Statement of the Vote,” there are no costs to generate this document that is directly attributable to the request itself outside of the medium by which it is transferred (i.e. CD-ROM). This document was already present, in its electronic form prior to and disconnect from the idea that someone may in fact request a copy of this file at a later time. In my opinion, such an excessive charge thwarts the right to access provided under law.

I also ask that you reconsider this determination in view of Prop 59, which has amended the state Constitution to require that all exemptions be "narrowly construed." Prop 59 may modify or overturn authorities on which you have relied in the past.

Finally, should you deny this request to obtain this document at reasonable cost, you are required to provide a written response describing the legal authority or authorities on which you rely. Please also address the question whether Prop 59 requires disclosure at a lesser fee even though authorities predating Prop 59 may appear to support your exemption claim.

If I can provide any clarification that will help expedite your attention to this request, please contact me at 909-396-XXXX. I ask that you notify me of any duplication costs exceeding $5 prior to the generation of any copies; however, I must ask that a reasonable justification be given to any charge I am assessed.

59. requesting a $65 fee
the extension (which took too long to find out) for the election division is 4401.
we can email a request for the SOV to
erose@co.kings.ca.us

The woman on the phone wasn't sure about a pdf format, mentioned a more costly
CD, and was only sure the "book" (SOV) cost $65

If it's on a CD, how hard is it to get a pdf version from that?

96. Hard copy only for $2.50.
25 pages at .10 a page. Only 10,000 voters in the county.
Is it of use as hard copy? They say no electronic file is available.

I mentioned FIA and she said it always costs this for anyone.
It's $10 per race or $40 for the whole thing on CD.

Dear Ms. XXXXXXXXX,

Pursuant to my rights under the California Public Records Act (Government Code Section 6250 et seq.) and the California Constitution, as amended by passage of Prop 59 on November 3, 2004, I am writing to request a copy of the following records, which I understand to be in the possession of your agency:

“Statement of the Vote” (or perhaps titled “Statement of Vote”) for the 2004 General Election, as sent to the Secretary of State, in its electronic form (i.e. pdf, excel).

I ask for a determination on this request within 10 days of your receipt of it, and an even earlier reply if you can make that determination without having to review the record(s) in question.

I would not ordinarily trouble you with this written request, but I have been told the document may not exist in electronic form, and that there may be a charge of $45. These statements by the County are of concern. I respectfully suggest that this position, that the County does not have this report in its original electronic form, defies logic and known facts related to the processing of the State’s election returns. Not only was the report very likely drafted electronically, but it also should have been sent in such a form to the Secretary of State’s office. The proposed charge of $45, if I understand it correctly, is also wrong. It is wrong because only direct costs may be assessed, and in the instance of the “Statement of the Vote,” there are no costs to generate this document that are directly attributable to the request itself outside of the medium by which it is transferred (i.e. CD-ROM). This document was already present, in its electronic form prior to and disconnect from the idea that someone may in fact request a copy of this file at a later time. In my opinion, such an excessive charge thwarts the right to access provided under law.

I also ask that you reconsider this determination in view of Prop 59, which has amended the state Constitution to require that all exemptions be "narrowly construed." Prop 59 may modify or overturn authorities on which you have relied in the past.

Finally, should you deny this request to obtain this document at reasonable cost, you are required to provide a written response describing the legal authority or authorities on which you rely. Please also address the question whether Prop 59 requires disclosure at a lesser fee even though authorities predating Prop 59 may appear to support your exemption claim.

If I can provide any clarification that will help expedite your attention to this request, please contact me at 909-396-XXXX. I ask that you notify me of any duplication costs exceeding $5 prior to the generation of any copies; however, I must ask that a reasonable justification be given to any charge I am assessed.

You can remove the question mark after my name. But I'm just getting started, and won't have much time until Sunday (12/12) then I have a couple days. I will be unavailable and off-line for the rest of today (Thurs. 12/9)--but I'm here now for about another 45 mins.

I live way too far away from SB to travel there, for any records checks, but might be able to come up with some contacts in SB who would be willing to do so.

I don't know how to email "geo" or other DU members, or how you will email me. I haven't paid much attention to DU mechanics, but will look into it.

Do you have a primer on getting started? (beyond reading these two long threads--a compiled list of suggestions/urls for beginners?)

San Bernardino "Certified final official results" (11/29/04), are at the SB Registrar site:

There are some slight differences between the SB Registrar (11/29) and the SoS (12/7) numbers for SB, which I will look into. SoS lists SB as an "updated" report, at

I have not found an SOV for SB. (Where would that appear--at the SoS site?)

San Bernardino numbers are already looking very strange to me. For instance:

Bush 55.17% (SoS, a week later, 55.4%)
Kerry 43.44% (SoS, a week later, 43.6%)
Other: 1.39%

(Senate Dem) Barbara Boxer 49.71% (SoS, a week later, 49.8%)
(Senate Rep) Bill Jones 45.32% (SoS, a week later, 45.4%)
Other: 4.97%

(Note: The 1st % is SB Registrar 11/29--as I said, I'll look into this difference later.)

Boxer is known in the state (to wingers) as a far leftist. She would most certainly be perceived as a threatening woman by rightwing white males (and there is a strong Christian right element of in this county). How could she outvote Kerry by 6.3% in the same electorate in which Bush outvoted Kerry by 11.73% (!) and in which Bush got almost 10% more votes than his ticket mate, the Repub. Sen. candidate Jones (Boxer's opponent)?

This makes no sense. It means that a significant % of Bush voters (est. 5%?) must have voted for Boxer! --when they had a conservative, right to life, white male Republican Sen. candidate, Jones, to vote for, to go along with their vote for Bush.

To put it another way, why would a Bush voter go out of his/her way to NOT vote for a rightwing, male Rep. Senate candidate, and to vote instead for a known leftist, feminist Dem. woman?

As ticket splitting, it makes no sense--particularly in San Bernardino. I understand that this same phenomenon occurred elsewhere (Kerry got less votes than Boxer in 44 of 58 Counties in the state), but it is particularly non-sensical in SB because of the overall tenor of the county--a trend to the right.

SoS reg voter figures as of 10/18/04: Rep = 42.69%, Dem = 38.68%, and AIP = 2.42%.

I would very much like to see updated voter reg breakdown (SB added about 10,000 reg voters in the month before the election), and precinct data--neither of which I've been able to find.

I would also like to see the breakdown between paper and e-voting. (SB Registrar official returns says only that about 20% voted "absentee," while the "precinct" vote was 52%--for a tot. of 71.6% turnout. No further breakdown by voting method. No figures for how the vote went between the two given voting methods. I will try the SoS site for voting method.)

SoS, voter reg in SB, as of 10/18/04:

Total registered voters: 727,138
Dem: 281,237 (38.68 %)
Rep: 310,411 (42.69 %)

AIP: 17,562 (2.42%)
Green: 3,040 (0.42%)
Other: 11,364 (1.57%)*
Decline to state: 103,524 (14.24%)

*(includes "Misc." 4,254 votes, 0.59%--whatever that means)

Could Boxer beat Jones by 4.4% in a county where Rep's have a 4% edge in registration? Perhaps. (Male/female voting % might be important on that one.)

But the key question is, how does Bush pull 55%, and Boxer almost 50%, while Kerry gets only 43.4%, in this county?

If some Rep. women voted for Boxer on fem issues, how did they reconcile that with voting for Bush, as opposed to Kerry (more likely to protect women's rights)?

I'm also suspicious of the Dem reg figure for SB. SB used to be a big Dem/union county. True, the right has made inroads. But to that extent? (And I happen to know there was a big Dem/grass roots voter reg campaign in SB in '04. I need to find out the breakdown of those last 10,000 reg's in the final month.)

Can anyone point me to (for SB):

Updated voter reg breakdown?
Precinct data?
Paper vs. e-voting breakdown?
And where SOV will appear when it's filed?

Summary so far of the project to date:

1) Adding volunteers, please Pm me with which county and I'll add.
2) Review the EIRC data for your county looking for odd reports or odd patterns in the reports. Just be familiar. voteprotect.org
3) Get in contact with your teammates, find the SOV for your counties, post the link, phone info, etc. (see examples in this thread).
4) Try to determine who will help coordinate amongst team members.
5) Someone willing to help coordinate with a group of teams... please let me know. :)
6) Make sure to read the thread rules above so we can keep the thread easy to navigate, since we may end up with lots of posts.
7) The project will be a little more full gear once I can get the spreadsheets comparing precinct level results and registration data up online for team and group analysis. Depending on what we find, we might be in for a heehaw good time. :) :)

Thanks for posting the analysis! I too have a feeling San Bernardino and Riverside are well worth the audit....

I'm a little confused as to what an SOV is. Yesterday I found this:

The "Certified final official results" (dated 11/29/04) for San Bernardino, at the SB Registrar site:

Is THIS the SOV? (And is the SOV supposed to be final-final (the last word on the election from the SB Registrar)? --I presume so.)

Now, go to the CA SoS site that lists status of the county's reporting:

San Bernardino is listed there as an "updated" report--that is, "updated" after the "final" report on Election Day (indicated by a "U" next to San Bernardino).

Does "U" (updated) mean that the SB Registrar has filed its SOV (final-final report on the election results)?

If the "Certified final official results" (dated 11/29/04) for San Bernardino, at the SB Registrar site, above, is the same thing as the SB Registrar's STATEMENT OF VOTE, then we have a problem, because...

...these "Certified final official results" (11/29/04) DIFFER from the CA Sec of State results for San Bernardino (of 12/7/04) for President and Senator (at least), at:

I downloaded the pdf (515 pages - 30 minutes) that has the precinct results (and breakdown of Absent vs "precinct" vote). I will re-check the figures at the SoS site. Would SB SOV be indentified as such at SoS site? (-where, currently, they have SB listed as "updated"--is "updated" the same thing as the SOV?)? SB Registr "certified" results at SB Registr site dated 11/29/04. SoS "updated" results for SB dated 12/7/04.

CA SoS has the following statement at the top of his pages giving the CA '04 results.

"In order to prepare the official Statement of the Vote for the November 2, 2004 Presidential Election, these pages are no longer being updated. The official final results will be posted after they are certified on or before December 11,2004."

This answers my question (I think): Are the results for San Bernardino that are listed as "updated", that are currently at the SoS site (results dated 12/7/04)--which I checked on 12/9 and 12/10--the same as the SOV for San Bernardino (or others)?

The SB Registr "certified" their results (stated on their page of results--dated 11/29/04), and this IS their SOV (apparently). But it is NOT the CA SoS's SOV. That's happening right now, and they could clean up these discrepancies (between SB Registr results of 11/29, and current SoS results of 12/7/04) for the state's final results (the statwide SOV).

Hi Peace Patriot,

The county send its data to the Secretary of State in a report titles "Statement of the Vote" or "Statement of Vote." The Secretary of State funnels all that data into its report also called "Statement of the Vote." The final tally for San Bernardino County should match what is reflected on the Secretary of State's report as well.

When we get all the data together into a form that is more user friendly we'll be able to quickly spot discrepancies as such. We can run this kind of a check on a state-wide basis once the Secretary of State publishes the report. At that time, we can ask counties and/or the Secretary of State to offer any necessary explanation.

On Dec. 1st I clicked the link and was able to download the file. Since that time, the link takes me to a products page that doesn't have the info on it. This means that someone over there took a perfectly working link and broke it! Ouch....

Keep checking back for an update under the L.A. County SOV posts that are a little upthread. I had to send in a CPRA request for the full file, and it appears there is a chance that the pages online do not match 100% what was sent to the Secretary of State. :) -G

Why are people sending an email request for the SOV? I downloaded San Bernardino's--a pdf file--from the SB Registrar site. Did you want us to get it in another form (and we have to request that)? (I can see why you'd want it in another form. In pdf form, it would take hours of copying and pasting 515 pages of data, then reformatting it--to make it at all useful. Did you want an Excel attachment, or what? Sorry if I missed this directive.)

Hi Rumpel,

I wouldn't worry to much about the electoral college vote, though I did hear some rumor that there were grumblings amongst the electors about what was going on in Ohio, so it may turn out to be a good thing to check out on C-SPAN (2pm our time).

The main thing for us is to see if the totals gave Mr. Bush a pad in the popular vote that wasn't deserved.

Kerry won in CA.
Also, CSpan is supposedly airing the Conyers hearing around the same time. They say Madsen spoke, too. Tough choice.

I have to hear the Cspan explanation of the electoral college again. A National Archives lawyerexplained it to, I think, reporters.

83. Ventura County SOV - still following up...
I emailed to find out why the SOV wasn't up on the Ventura County Elections site and I got this email response:

You may purchase an Excel file copy of the statement of
votes from our office for $52.70. We require cash or check in advance.
If you want to send us a check we can mail you the diskette if you
cannot visit our office.
