Top court backs Wal-Mart over union store closing

Published On Fri Nov 27 2009

OTTAWA – The Supreme Court of Canada turned down Friday a long-fought appeal by Wal-Mart employees who banded together to unionize before the corporate giant shut its doors Jonquiere, Quebec.

In August 2004, the Saguenay region store was the first Wal-Mart to unionize in North America, but the bid by 190 employees didn't last long.

The decision does not govern employers or employees in other provinces, which each have their own labour code. Nor does the ruling make any sweeping conclusions about the right to unionize or not.

"The closing is not only punitive for those employees who attempt to unionize, but also sends a general message that unionization is an endeavour that carries the risk of the loss of jobs for all employees in that workplace," Abella wrote.
