Prosecutors fear castle law's 'presumption' will allow real murderers to go free

For many Texas legislators, last year's castle law seemed like a no-brainer. Anyone breaking into your home, car or business poses a grave threat; you should have the right to shoot first – and ask questions later.

The new law has yet to see its day in court, but that day is coming. Homicide cases that pivot upon it could emerge by the middle of this year.

Meanwhile, some prosecutors worry the law will cause more confusion than clarity in the courtroom.

Worse, they fear it will let real murderers off the hook.

1. Why don't we just kick the "Lone Star" state out of the Union????
It would be a separate country and we could bomb it just like Iraq and Afghanistan.

6. Speaking more as an individual than a Texas resident,
with each passing day here in Bushco/Democrat Enabler USA, I'm ever more uncertain as to just what the supposed advantages are of being part of the United States anyway. The way things are going, you won't have to kick states out of the Union. They will secede.

3. The Dallas Morning News disappoints again.
The "Castle Doctrine" law is doing just what it was intended to do - place a heck on prosecutors. This was well known by anyone who followed the development of the law as the legislature was writing it.

Perhaps now Texas cops will be more careful about getting the address right before the smash the door open.

11. To be a Republican in Texas, you must believe that a doctor who saves a woman's life by terminating
her doomed tubal pregnancy is a murderer but a property owner is presumed not to be a murderer so long as the property owner can manage to lure the intended victim onto his property before shooting his victim in cold blood.
