clear and correct:

"Benkiser could not constitutionally find that DeLay was ineligible on June 7, the date she made her decision. Therefore, her application of the ineligibility statute to DeLay was unconstitutional."


"There is evidence that Benkiser did not act reasonably and with political neutrality when she declared DeLay ineligible. Indeed, the district court’s description of the events surrounding the letter sent by DeLay imply, at the very least, a lack of neutrality."


"we fail to see how removing DeLay from the ballot would protect the voters, inasmuch as it was the voters themselves who selected DeLay as the Republican candidate for the general election."

Tom DeLay says he's moved to Virginia, and isn't even a Texan anymore
Tom DeLay doesn't want to represent Congressional District 22, says he's being forced to run by the courts

5. Nick Lampson and the voters will declare him ineligible
on November 7th, when Nick declares victory.

Then Tommy can continue to live in the 22nd, where we can all smirk at him, all through his trial, until he's behind bars.

Here I was under the impression you lived in Sugar Land. I guess you moved to Virginia, huh? Or was it DeLay moved to Sugar Land, or his wife does/was living there? Geez, my head aches. I just hope someone is feeding the poor dog. LOL

Actually, if he's at Ninfa's, try spiking the dreaded green sauce. He'd never know (til later, hehehe).

He lives right here, about 2 miles from me. It's a nightmarish experience to see him when you go out in the community. Gross.

They can only go so far in bending over for the republican train of though without totally decimating the law. It was a clear case and our lawyers representing did a hell of a job laying out the case. Kudos to them!

5th Circuit Court of Appeals Agrees with Texas Democrats on DeLay Ballot Challenge

The 5th Circuit Court of Appeals ruled in favor of Texas Democrats a short time ago. As a result, Tom DeLay remains eligible for the 2006 general election as the Republican nominee for the 22nd Congressional District of Texas.

Of course the Repubs are already planning on heading to the USSC for them to do their dirty work. If that doesn't work then they most likely will try some other scam.

This could have all been avoided had Gov. Goodhair called a special election to replace him legally and fairly by holding a special election, where the voters could have voted for his replacement. But instead they decided that the voters weren't important enough to make that decision. They only wanted to handpick his replacement not the voters.

The DeLay Repubs are bunch of idiots!

13. You're exactly right
All of this could have been avoided if Perry had called a special election. The voters could have not only picked who they wanted to represent them, but they would be represented, instead of not having someone in the House.

I'm praying that Delay and this whole ordeal goes straight down in flames for him and the rest of the crooked Texas GOP.
