NYer's - Help on NY State Unemployment
I was let go from my job through no fault of my own, however the place I worked had extremely high turnover and they screwed the last person in my position out of unemployment by declining and stalling until she eventually went away.

What I want to know is, do I have any recourse at all in this matter? They haven't declined me yet and they are giving me a month of severance, so I can't collect for a month anyway, but I am worried.

I have to move at the end of April and I cannot afford to go even a week without income. (I spend every day sending out cover letters, resumes, etc, but I don't know when I will find work.)

Thanks in advance for any advice you might be able to give me! :)

I am not sure if the severance package matters.

ON EDIT: You are ENTITLED to unemployment. You pay premiums for it. That is why it is called INSURANCE! If your employer fights you, you can appeal. There may even be labor lawyers who would do it pro bono.

Sorry I didn't reply sooner - I was away and didn't have access.

There is one thing I don't understand, if you could possibly clarify - I thought the employer paid the unemployment premiums, however you said I paid the premiums. Could you explain that a little further if you are so inclined? I don't quite understand how it works. Thank you!

6. Question about NYS Unemployment Benefit extensions, please help...
Hi, am new here and was wondering if someone can help me so I can stop worrying...

I filed my Unemployment claim I believe Oct 18th of 2008, so far I used the initial (regular) 26 weeks of benefits, am on the 33 weeks of emergency benefits, of which I have used 20 weeks this past Sunday - so I have 13 weeks remaining.

Now I was told I have to file a claim again on Oct 19th of this year - as 1 year claim is up. Am I still entited to the remainder of the 33 weeks of emegency benefits, i.e. will the leftover of that get carried over into the new year's claim?

Also I have noticed that another 20 weeks (7 and then 13 = 20) of what they are calling "extended" benefits (with work search) was also added, but they expire to claim no later then Dec. 27th 2009. If I am counting the weeks correctly, assuming the remainder of my 33 weeks emergency benefits so get carried over into the new year's claim they should take me through to Dec. 27th 2009. So I guess that means I am not eligible in any way for these "extended" benefits? Seems a bit unfair, or prehaps they will extend the deadline as the state is still above 8% unemployed. I also heard that Congress approved an additional 13 weeks (am hoping this will go into 2010, and not just end at the end of 2009 as well).

Anyone who can make sense of this for me, I would greatly appreciate it! :) I'm sure some of you share my fustration with the job market and seeking employment. I was making decent money as a supervisior for a big company with great benefits and I have yet to even find a job that pays anywhere near what I was making forget the benefits! It seems the employers know people are hard up and are taking advantage of the sitution and offering crap money with salaries in the low 20K with if you are lucky 1 week vacation... I have been looking regularly and just can't find anything - am considering now looking out of state...

2. Severence doesn't matter
You can collect unemployment while collecting severence, as long is you've used up vacation pay and any other accrued time you're being paid for. If they gave you a month's severence, it's going to be harder for them to fight the unemployment.

if I look for a job in another state (and live there while I am looking?)

hello,
im looking for any help I can get on my situation. it’s a little involved:
I am not a resident of ny, but rather of new mexico. I work as an independent contractor (musician) on most jobs I do, however, the largest sum of my income comes from a company (non profit) in new york. they file a w-2 for me and take out and all that business. they are the only company I work for that does so. the work I do for them in not all the time, but is consistent and from what I can calculate exceeds the minimums for applying for unemployment. they are about to lay me off. my boss called me and told me our upcoming tour in oct. would be my last with them. its no fault of my own. They are restructuring the company.
my question is: DO I HAVE ANY CHANCE FOR FILING FOR UNEMPLOYMENT IN NY?
ive read quite a lot but cant quite seem to get a conclusion. any help would be greatly appreciated.
