Statement of Corzine for Governor Campaign Director Steve DeMicco



Reading Acting Commissioner’s Bryan’s letter today, it is clear that Doug Forrester – through his 51% interest in both Benecard Services, Inc. and Heartland Fidelity Insurance – is in the business of selling insurance in New Jersey.



Bryan’s letter also confirms that a Business Registration Application filed with the New Jersey Treasurer establishes that Heartland “maintains a work location at the offices of Benecard Services, Inc. in Lawrenceville, NJ, where administrative services are conducted.” This additionally confirms that Heartland is conducting the business of insurance in New Jersey.



At the same time the Department of Banking and Insurance observes that it does not regulate captive insurance companies because captives are illegal in New Jersey, it confirms that Benecard Services, acting as Heartland’s general managing agent, is engaged in activities that “necessarily include some insurance business activities.”



Thus Bryan concludes that, by virtue of his ownership of Benecard, Mr. Forrester “is subject to the Department’s regulatory oversight under applicable statutes and rules.”



As such, Mr. Forrester’s political contributions violate N.J.S.A. 19:34-32 and -45.



The Corzine campaign has, therefore, sent a letter today to Attorney General Peter C. Harvey formally requesting that the Division of Criminal Justice investigate this matter for a determination that Mr. Forrester’s contributions do, in fact, violate the law, and to take appropriate action based on that investigation (letter attached).



Finally, it is clear from Acting Commissioner Bryan’s letter that Mr. Forrester – by maintaining two companies that are alter egos of one another – has engaged in an elaborate scheme to circumvent New Jersey laws and to avoid their more stringent regulatory requirements.



Bryan’s description provides irrefutable evidence that Doug Forrester – by dint of his majority interest in both companies – is soliciting, promoting, transmitting, servicing and receiving payment for insurance products in New Jersey and under contract with New Jersey customers.
