Brizzi addresses relationship with investor

Updated: Dec 07, 2009 7:19 PM EST

Indianapolis - Marion County Prosecutor Carl Brizzi released a letter Monday, addressing his relationship to millionaire Indianapolis businessman Tim Durham.

In the letter, which was posted to his Facebook page, Brizzi says he has called Durham "a friend for several years." He writes that Durham has contributed thousands of dollars and "in-kinded event costs" to his political campaigns over the last seven years. He says all of those donations have been reported as required by law.

FBI agents raided the offices of Durham's Obsidian Enterprises in downtown Indianapolis last month as part of the investigation.

The prosecutor explains his nomination to the board of Durham's company, Fair Finance, in September of this year and how an investigative piece on the company by the Indianapolis Business Journal led to his resignation from the board the following month.

"In the limited time I served on the board, I never attended a meeting and was never compensated for serving as a board member. I never borrowed money or received contributions from Fair Financial or Fair Holdings," Brizzi wrote. "Most importantly, I am unaware of any illegal business practices associated with Fair Financial or Fair Holdings."

Brizzi also disclosed his stockholdings in a company called Cellstar, with which the Securities and Exchange Commission is investigating Durham's role.

1. Brizzi Talking Bull on Durham?
The Star reports that Brizzi bought CLST stock before Durham became a board member.

Umm, Carl, what in God's name would make you say, "You know what? I'm going to invest $10,000 in a struggling, Texas-based wholesale cell phone company?!?!" I'm supposed to believe you didn't get a wink or nod about CLST from a guy who was your biggest donor?

Brizzi's defense is that he lost money on the stock, which is worth about ten cents a share now. Sure, the stock lost value, but Durham was elected to the board to sell off the assets and distribute the proceeds to the shareholders. How much did Brizzi get on the distribution?

Also, where did Brizzi, a guy who has been on the public payroll longer than I can remember (since 2002 as Marion County Prosecutor, then under Scott Newman, and before that, under Dan Burton) get the money to invest in Harry & Izzy's? And how much did he invest? It's a nice spot (with great steakburgers, so kudos to Manager Jeff Smith), but there's no way that decor was cheap.

Brizzi needs to come clean on his finances. Whether he does or not will tell you whether he can. And if he can't, you won't see him on the ballot in 2010.
